  • Hi, Just a quick update.
    I wrote to Thomsons on the 1st of November asking them to reconsider my claim for compensation for a delay of 23 hours 50 minutes from the 27th Febury 2009 (Manchester to Male Maldives).
    It's now 60+ days since I contacted them and I have had no contact from them at all.
    I decide to phone them yesterday to chase it up. Same old story the lady I spoke to could not give me any details and said she would have to email the claim team and wait for them to update her and she would then ring me. She said that would be at least 48 hours.
    Total joke! I know the received my letter because I used recorded delivery.
    When I originally made my claim I also got in contact with the CAA (I was given a case number etc) so decided to ring them at see if they could help.
    I explained I had contacted Thomson again and asked them to look at my claim for compensation again and that it was 60+ days since I wrote to them and still no reply.
    At first the CAA said they would contact Thomson and chase it up for me then he realised it will be 6 years on the 27th of Febuary and they said it was to close to the date for them to help.
    So after feeling totally stonewalled and deflated I decided to contact Bott & Co.
    I have received a email from them saying they will take up my case.
    I know I will have to pay them if they win but time was ticking and it was the last resort.
    I can't belive Thomson etc are still ignoring claims and giving people the run around.
    I hope I have done the right thing!

    Exodusone - you have done the right thing! Possibly would have been more beneficial to front your own claim but rather than walking away by using Bott & Co you should achieve the majority of your entitlement but more importantly Thomson will get yet another smacking.
  • You should have started your claim earlier by giving the 28 days NBA. You could start it by yourself.

    NBA can be 14 days; doesn't need to be 28. And there's nothing wrong with going with a reputable NWNF company if you lack the time, confidence or capability to take the case to court yourself: though most people should be able to do it, particularly with the support available on here, it's not for everyone.

    Thanks for your replies guys. I could of done it myself but with family commitments and work etc I think the best choice for me was Bott & Co.
    I will keep you updated.

    I'm at a loss as to what to do with my claim so any advice would be welcome. Oh, first post on here by the way!
    Our flight to and from Orlando this summer was delayed by more than 3 hours so I wrote to Thomson asking for compensation. I didn't receive a reply for months so I called them and they emailed me their response. In a nutshell, rejecting the claim stating 'extraordinary circumstances'
    No shock there, but in their reply they only addressed the outgoing flight and completely ignored the return flight that was delayed for over 4 hours. So I emailed them this time, I sent the original letter and highlighted the return flight info. I also sent a strongly worded email regarding them ignoring my claim. So today I receive a reply... Guess what? Yup, they completely ignored the return flight again and only mentioned the outbound flight.
    This is what they are stating.
    Outbound - "their delay handling logs show the flight was delayed due to technical issues with checking in at Manchester airport. This is not something we as an airline have control over."

    This may be true, so I'm unsure whether to continue the claim for this?

    However, the return flight was delayed due to the plane not being there. There was a knock on delay which had lasted for days according to the Thompson rep at the airport. This flight I am sure we are entitled to compensation...... But after one recorded delivery letter and 2 emails, Thompson have completely ignored this.

    What are my next steps? Any advice?

    Vette - i would treat each claim as a seperate entity ie submit a claim letter for journey. This will avoid confusion and/or Thomson just ignoring your second claim until you get fed up or out of time.
    Its probably time to send an NBA for each flight and/or contact a MWNF firm if you don't want to do it yourself.

    This is my first post on this subject, so I hope I have done this correctly. I have looked at Vauban's guide, but I am not sure it can help in my case.
    I contacted Thomson by email last September, regarding a flight delay on 2.10.2008. I have since followed this up with further reminder emails.
    As you can see, the 6 year deadline for legal action has expired, but I have tried to follow this up direct with Thomson anyway, as my initial email at least registered a complaint before said deadline.
    My problem is that apart from the automatic replies to my emails, I have had no contact from Thomson, whatsoever.
    Can anyone please advise me how to get a proper response?

    Peter the only way of getting a response would have been to issue a court claim. Unfortunately it would appear you failed to do this so you are now out of time. I suggest you just forget this now and move on (hopefully with a different airline) and recall the problems that Thomson gave you in 2008 when giving consideration to who you book with in the future.

    I certainly agree with you about inadequate Judges. In my case even after specifically requesting, in writing, for an oral hearing, the Judge went ahead and made a paperwork decision. I still feel angry as I could prove with evidence, that it was all Thomson's lies. I calculated a loss of £3000 all due to the Judge just reading the words "extraordinary circumstances "in the defendant's defence. He obviously ignored my specific request for an oral hearing which stated I had proof to present. Good luck to you.
