    Has anyone used Bott & Co? I started a claim for 15 of us back in January and I understand they were waiting for the supreme court ruling but still my case has had no input in it since 10 February 2014! Can I try and do this myself the only reason I went through the company is because there is so many of us and I dont really understand the ins and outs. Any thoughts would be gratefully received!

    I have and they have told me that my case hadn't had any court proceedings actioned yet and they have contacted Thomson about those that have had and are awaiting a response before they move forward with any other cases and to be honest they do not seem particularly interested when you contact them it almost feels as if I am a just a pain in the rear end!

    I've not read anything bad against them on here, I'm sure that they are on top of things for you. Remember they will have thousands of cases and you are just 1 of those. Compared to standard solicitors fees £250+ per hour, charging around 30% of the 'unexpected benefit-J2' seems to me a reasonable amount.

    to be fair it is Bott & Co who have got us passed the impasse of Huzar and Dawson. They will have stacked up, I suspect, thousands of cases due to stays by the courts, and these will need clearing as a priority. If they have a case in the system at court that is paid out, that is the same flight as yours, then it is likely that your case will proceed/payout without the need for legal action. It is all a bit up in the air,
    though, as some airlines seem determined to fight every case tooth and nail.

    I understand that Thomson are now settling claims, but are insisting on confidentiality as part of the deal. More interestingly, they are also playing hard ball over interest and rates of currency exchange. If however you hold firm, the anecdotal evidence is that they are agreeing to settle on your terms. (And frankly why wouldn't they? The costs of turning up at Court are so much greater, it's much cheaper to deal with you fairly.)

    I wonder how the judges would view a case where settlement included a gagging course but you refused and it had to go court?
    Given that the reg is law and doesn't include any clauses for "bargaining" I would have thought you would not be looked on unfavourably?

    The only problem in pushing for full interest (say 8%) and a favorable exchange rate is that if you do continue to court a judge MAY consider you are taking up court time for a few extra quid and whilst you may wish to 'stuff' the airline be careful that you are not trying to score a few extra points/£ and shooting yourself in the foot.
