    Yes.

    They have done the same to me throughout. The only documents I have received directly from Thomson was their bundle (and some of that was late).

    Keep a list handy of all the documents Thomson have not 'served' to you and make sure the DJ knows about their unreasonable behaviour.
    The above is just my opinon - which counts for nowt! You must make up your own mind.

    Similar to MGOR AND Roywad, Liverpool CC have responded today to my 4th November letter post Huzar & Dawson.
    The stay is lifted :T
    Thomson have until 4pm on 22 December to write to the Court and claimants (!) to say why their defence should not be struck out on the basis there are no reasonable grounds to defend the claim.
    Upon receipt of any such letter, the file will be referred to an 'Airline Judge' for consideration
    If no letter is received then defence will be struck out and we can enter judgement for the sum claimed. Either party subject to fee can apply to have order set aside.
    Still no response from Thomson.

    As I understand it, quite a lot of people who live nowhere near Liverpool have had their cases referred by MCOL to there. This is because they have developed a bit of an expertise for handling 261/04 claims - and the anecdotal evidence suggests that their judges brook no nonsense from the airlines.

    I thought obviously wrongly that MCOL would transfer the case to your 'local' court?

    This happened in my case, but that is because I, when given the option chose Leeds as my local court.
