I'm not sure why Thomson would request a gagging clause, there has been enough publicity over the regs, they should be proud to say that they are now paying out legitimate claims, unlike other airlines. It's just needs to be spun right and it could be a PR success story.

I sent a letter to Thomson regarding a 23 hour flight delay. I used the template and gave 14 days from 11/11/14 to respond. As yet I have had no acknowledgement of the letter. What should I do next ?0

Start court action is the short answer. Sadly, most airlines will only take your claim seriously when they are forced to.

to be fair it is Bott & Co who have got us passed the impasse of Huzar and Dawson. They will have stacked up, I suspect, thousands of cases due to stays by the courts, and these will need clearing as a priority. If they have a case in the system at court that is paid out, that is the same flight as yours, then it is likely that your case will proceed/payout without the need for legal action. It is all a bit up in the air,
though, as some airlines seem determined to fight every case tooth and nail.
I completely appreciate that they are busy and that their work has resulted in great news but what I was trying to say is that I felt fobbed off by the person I spoke to a couple of weeks ago and when our case pays out we will be paying them around £3000 for our party which is a lot of money and I expect a decent service for that money!
That said I am putting that call down to the guy having a bad day and I know all about those! I had a call from them yesterday and spoke to a very pleasant man who I am very pleased to report advised me that Thomson are now paying out and have a spreadsheet of 3500 names that we are on to settle. They are just smoothing out a few issues :-)0 -

3,500 that's one hell of a lot of names and cases, excellent news for you, Bott & Co and everybody on that list.

Finally had a response from the Court regarding my request that they set aside the original stay.
Both parties have been asked by 4pm on 02/12/2014 to file in Court and serve on the other party:
a) A brief summary of its arguments on the application
b) An indexed and paginated bundle of authorities.
What is this all about?
Surely, my case is quite simple and I've already stated this on the original small claims court document?0 -

Well the "21 days to process your payment" came and went! Now going to court to ask for D/F judgement as they did not comply with the judges directions by 17th September, this case was never stayed so didn't have to worry about getting it lifted but the judge requested they supply all sorts of stuff but they never bothered, I initially accepted their offer of £1039 but as this never materialised I have gone to the original figure plus interest from the date of issue which now totals £1124, they said thet would defend on the basis that when I issued my original court claim I issued it to TUI/TJHOMSON finger must have slipped when typing Thomson,strange how they defended against this claim and also offered a settlement on this claim and hen stated that it was for the defendant Tjhomson and thats not them!
Interesting what a judge makes of that as their offer did not include the famous "without prejudice" title so they will have to respond to why they made such an offer and why they attempted to vigorously defend the said claim.
Going to court Monday to request judgement, anybody know if I need to submit particular form?
I tried one final email to them with my BACS bank details but as they have not responded to my previous 3 asking where my money is I don't hold out much hope of a reponse.0 -

Well that could mean your in trouble if you have not prepared your bundle. You need to file your court bundle to court and the defendant and skeleton arguement by 2nd December 2014, if you have not already then you need to get cracking on your court case.Check out Vaubans Flight Delay Guide, you will be glad you did....:):)
