    Took my Appeal form N164 by hand, to the county court. I've requested an oral hearing as I had previously written expressing this and I did not agree to the Judge making his decision on paperwork alone. Which he did anyway!

    The errors committed by the court are numerous and careless. Shouldn't happen. Does not instil confidence in the justice system!

    Would I be given a different judge do you think? I would prefer that. I know nobody will like being accused of not doing their job correctly! Especially a judge!

    I had two hearings due to Monarch incompetence and had two different judges.

    Finnair said extraordinary circumstances applied only to a 'particular aircraft on a particular day' ie not to the flight before etc.

    I'm having a bad day and thought I would share with you! First of all my Appellent's Notice has been returned to me today. I had not included another £120.000 with the form. I phoned the court and eventually was answered.

    I told them I was waiting for the reimbursement of the £170.00 Hearing fee as I did not get a Hearing! It was decided on paperwork alone.

    I then told the person that I had written to the court requesting an oral hearing.

    Wait for this! I was then told "just because you requested a court hearing it does not mean you will get one". I replied why, on the
    notice I had received, it had said that "if you wish to have an oral hearing to write in? Then I was told "the Judge will still decide on paperwork if he thinks he has all the information".

    What is the point of wasting my time if this wasn't going to happen anyway?

    I then said I wanted to present my Skeleton Argument on the day of the hearing. I was then told "you cannot present this on the day of a hearing as the Defendant should receive this 14 days before the hearing".

    I'm stopped every which way I turn! I now have found that, my current home insurance company will not give legal help because I wasn't insured with them in 2010! After contacting the company I was with in 2010, and spending an hour on the phone speaking to various departments, I've been told they will not help me! This is because we did not continually take out insurance with them apparently! What a cop out eh? So why am I paying for legal aid on my policy? All everybody does is twist the facts to suit themselves.

    So now I've been told I won't get my money back for an earlier non hearing and also have to pay another £120.00 for an oral hearing which might not even take place!

    I'm being screwed by the big boys! I'm so desperate now I've even bought a Euro lottery ticket but with my luck won't hold my breathe! I can only dream of having a barrister on my side!

    Good luck - you actually probably stand more chance of winning the jackpot than getting any money out of Thomson.
