Hi Karen and white Robbie, I was Mexico ready to zip up the case, when I received a phone call saying we would be delayed by 24hrs. It was obviously your flight.
This is were the story gets interesting, because the week before when we flew to Cancun, we had two slight delays. The first was about 3/4 of an hour, reason fault with air con. Great not to long on our way, so we thought. We pulled away from docking area, moved about 10 foot forward and stopped, then we were told of a fault with a valve that starts engine, back to docking area while engineer checked it out. This time only about 1/2 hour, with captain saying valve ok and it only starts the engine so don't worry, and he started engine in docking area to make sure it worked, we're off.
26 hour delay on way home, and what did captain say was cause of delay, fautly valve that starts engine. He said plane took off from Manchester, but returned because they didn't want to get to Cancun then have to send engineers out from UK. So when they returned to Manchester, cabin crew didn't have enough hours to make the flight back to Cancun.
I sent a letter to Thomson for compensation, and have received the standard fob off letter. But I will not give up, I will write back with all the points I have made above and let them know I'm willing to take them to court. Exceptional circumstances do not happen every week.

Thanks for that I have written to Thomson and I am awaiting a reply. Will keep you informed if I have any response.

Hi justaskin, thanks for the reply. Your flight was after ours - seems Thomson had a lot of problems in April and May.

We were on the same flights as Cupcake77. Over 6 hours delay on outward journey and 22 hours on the return. Never got to see the infamous Dreamliner Thomson rave about!

We were told by a couple of people on desks at Gatwick that our outward flight was delayed because of a problem with the plane 48 hours earlier. I don't think it's reasonable for this to be affecting flights 2 days later.

    Hi

Finally I've found someone on the same flight as us :-)

Are you taking further action? I completely agree, exceptional circumstances shouldn't be happening on a daily basis which going by other posts, this is what they are saying.

I am waiting to hear back the reason for the 22 hour delay. Have they given you a reason for that one?

    Hi Cupcake77,

I am definitely going to claim compensation for both flights. I have downloaded the template but haven't got round to writing the letters yet. Will do do very soon.

We didn't receive a letter from Thomson about the outward delay, although I heard one of the cabin crew on that flight tell somebody we would be getting letters on our return.

The letter we were given back at Gatwick (at the luggage carousel) was about the home flight only.
It said "Your flight was original (sic) delayed due to a technical problem before departing from the UK. An alternative aircraft was sourced, however on arrival into Florida the crew had exceeded their legally permitted working hours, and needed to take minimum rest before operating back to the UK"

Just heard the news about flight compensation and thought I would look into it, although I am aware it was almost 6 years ago so might not be successful.

I have looked into this before - we know for a fact our flight was delayed because we had to go back to another hotel over night. But looking on the flight delay website it says the flight was only delayed for 15 minutes? So if anyone can point me in the right direction I would be grateful. Of course I have lost all the original documentation, boarding passes etc but I still have the emails confirming we booked the holiday.

    Thank you in advance!

If you reach the 6 year anniversary of the flight without having started court proceedings, you'll be out of time. An email confirming the booking is fine. When and where did you fly?

    Thanks for your reply!

Flew out from Gatwick to Paphos, Cyprus on 1 November 2008 and returned on 8 November (but was delayed for 27 hours).

Likely you will have to 'front' your own claim as close to the 6 year threshold which means unlikely that a NWNF will take on..... start reading up!

A couple of weeks ago I applied for judgement as Thomson hadn't complied with a court order due 6th May.
This morning I've received a copy of an order telling Thomson that unless they comply with the previous order by 23rd June the Defence will be struck out and judgement entered for the Claimant's for damages to be assessed.
I don't see why they are being given this extra time but I'll just cross my fingers and wait.
Thomson certainly can't accuse the court of not being lenient with them.
