  • Just wanted to give our SUCCESS story!! Scheduled to fly from Birmingham UK to Cancun last November, we were delayed by 4 hours was supposed to board plane at 12:20pm. We got on at 2:20pm then had to wait a further 2 hours because of some problem with the plane having expired flight dates so they had to manually update navigational system (or something like that). We eventually got moving at 4:20pm and landed in Cancun just over 3 hours late.

    On returning to the UK i emailed Thomson to complain about flight delay, a couple of weeks passes so i complained again. I eventually got a phonecall from Thomson and the lady was saying they dont compensate and i have to claim through travel insurance - i told her thats incorrect due to the new EU regulation which she then immediately told me she'll have to refer me to another department and they will contact me. 3 / 4 weeks later heard nothing so wrote letter using template off here enclosed boarding passes and e-ticket then 2 days after posting letter I get a phonecall to apologise and admitted they were at fault and in a position to give compensation at 600 euros per person so weve claimed 1200 euros in total... Result! Thats our deposit for our next holiday!!

    Have they actually said they will be paying you €600 each? This would be the figure if the flight arrived over 4 hours late, between 3 and 4 hours would be €300 each

    Yes the thomson guy said on the phone 600 each (as i was quite shocked when he said that), i did put on the letter we arrived over 3 hours late therefore we are claiming for 300 per person and from memory we were over 3 hours but not sure if it was 4. Have checked the flightstats website but it only gives an estimate to when we landed and not a true time. Thomson said will have cheque in next 28 days - but probably sooner as they are quiet at the moment!! So will see what we get through the letter box. Either way were happy just getting something back...
  • Been in the middle of a claim for getting close to a year now for a 6 hour delay from Birmingham to Barbados

    The short version is this...
    Submitted a claim to Thomson
    They replied saying there was a technical fault with the plane on that flight
    I referred the case on to the CAA
    Thomson have written back asking for "proof that we were actually on the plane"

    I already sent them a copy of my boarding pass when submitting the original claim. There was a party of 11, but only 1 person (me!) had kept their boarding pass stub.

    Any advice on how to respond?

    No. Some airlines are trying to reduce the compensation for shorter delays, but there is nothing in the legislation to support this.

    does that mean this link is incorrect when it states?
    3,500km+ (flights between an EU and non-EU airport), eg, London to New York
    3-4 hours €300 (£250)
    4+ hours €600 (£500)

    I just wanted to post to say thank you for all the info you have provided on the EU 261 legislation.
    2 weeks ago my family and I experienced a 18.5 hour delay from punta cana to LGW with Thomsons. On my return home I sent them a complain and mentioned the EU legislation. They contacted me on Saturday (2 weeks later) and conformed they are currently processing a cheque for £2500 as they are compensating us €600 each. There were 2 adults and 3 children involved. Was expecting a fight on my hands and a long battle, so was flabbergasted when they contacted me and didn't even try and fight it.
