  • I complained about this flight when we got home as we had a 24 hours 41 minutes delay (plane went 'technical' half way down the runway on take off :eek: and appalling treatment from one of the Reps. I also ask for my out of pocket expenses (£52.85) to be given to me. Got a letter back apologising for the delay and problems and suggesting I claim on my insurance (£50.00 excess on that!) that's all!!

    Well now thanks to MSE and the template letter they now have a request for delay compensation as well as my expenses.

    Thanks for the template:T, so many of these big companies try it on these days and wheedle their way out of poor service, it's about time they paid for their errors:mad:!! Might mean we all get better service in the end :rotfl:

    Surely the more frequently they are claiming this, the less extraordinary it becomes.

    What legal point would your list try to prove? The Wallentin judgement makes clear that the frequency of an event is no guide to determining whether it is extraordinary or not.

    Not only what vauban says there is already a joke list used by airlines called "NEB Guidelines".

    Your failing to get the point that airlines claim EC's as a matter of course irrespective.

  • Hi all, so i was in court yesterday and i thought id give my feedback, Thomson representative was talking to me before we went into the court trying to ask about the case and saying that its going to cost me so much money if i win today as they will appeal it!! Then when we got into the room, the judge started off by saying that he will have to amend the claim as i cant claim for my partner?? so im not sure if you have to put in 2 claims?? the judge asked a lot of questions to Thomson which he couldn't answer, at this point Thomson requested a stay. The judge has requested Thomson to produce n exact timeline of events as there was so many inconsistencies which Thomson asked if there is any point and it would cost them a lot more time to produce this (haha) to which the judge replied yes im requesting it so you will need to produce it. In the end once all the facts were recorded the judge stayed the case pending the Huzar case. Gggrrrrrrr Not sure if its ok to put all this info on here but was hoping to help someone else.

    Is that really acceptable pre-hearing behaviour?

    Do the CPRs say anything about that sort of conduct?

  • Thats what i thought Richard and he was talking to me for quite a while, i didnt really know what i should or shouldnt be saying to him pre hearing.
