Does that mean they don't have to provide these documents??

Yes, until/unless it goes to court

Good luck! Someone else was refused any information and I suggested that was probably a positive sign as they would let you know very early on if they had a good EC excuse. Make sure your court papers note that you asked and were refused.
  • Hi, After seeing Martins segment on this morning I have looked into a delay we had in 2008.

The holiday was booked with First choice and the flight was firstChoice airways but we had a Thompson aircraft. I have since learnt that first choice airways and thompson airways have merged. this would explain why it was always an thompson plane.

** I understand you cannot claim if airline has gone bust, but they havnt gone bust just merged, so does anyone know my status on this ? **

Who do I send my compensation request to ???

We were originaly schedules to fly at 12.30 pm on the 02/07/08 but due to a technical fault with the aircraft we were delayed until 10.00am 03/07/08.

First choice put us up in a hotel overnight and provided evening meal and breakfast but we had to pay for anything else and with 4 children and 3 teenagers in the party this was quite costly.

I have our original booking confirmation/invoice, some of the boarding passes and also have the letter given to us from first choice stating that our flight was delayed due to a technical fault with the aircraft and would be unable to fly until the next day.

Sorry for the long post, any advise would be greatfully recieved

Have a good read of the FAQs you will find template letters there to send
  • further to my above post

Re; the technical issue with aircraft, we were all borded onto the plane and waitied for almost 2 hrs with workers coming on and off the aircraft checking things before finally being told to leave the plane,

We then kept getting new boarding times before eventually being told around 6pm that we would not be flying that evening due to the technical issues, and that they had no other plane to use and also no crew to man the plane as they had all worked their allowed hours so had to wait for a plane to come in and a new crew in the morning.
  • I have read the facts and do believe we are entitled to compensation but its who to send letter to now they have merged, Im presuming thompson as it was their aircraft & crew and thats who first choice airlines have merged with
  • We are still within the time limitation also
  • Thank you, I am busy reading it through it and trying to make sense of it all and to see what applys to our case.

We were a party of 11, with 4 children, 2 teenagers and 5 adults, one of which is disabled and one who was 85yrs old and diabetic which was also affected by the delay due to the constant being told more flights times only for them to be delayed again, we eventualy managed to get him something to eat serveal hours later.

Use the template letter and send it the Thomsons
They will either pay up or refuse
If they refuse, look at the court process and decide whether you wish to do this yourself or go through a nwnf
The amount of compensation will depend on the distance of your flight..whatever it is I am sure multiplying by 11 will give you a nice sum - good luck
