Hi All,
I was wondering if anyone knows what happens if Thomson dont send me their bundle? I Had to send mine to the court and them weeks ago but have never recieved anything in return. Although I do know the court havent received anything from them either.0 -
Another quick question, without getting Thomsons reply of the cause of the delay, I've found it on the internet, my flight was well discussed on a thread on holiday truths
Turns out the day earlier 1 flight needed an engine change and another had a medical emergancy, both causing knock on effects, they did however have a spare plane they chose not to use and knew about the delays 24 hours prior to my flight? I assume none of this can be used as Extraordinary circumstances by thomson?0 -

I agree there are too many pages! So you need to learn how to use the search facility to get what you need.
If you search for Dawson in the general "flight delay" forum, you get this thread, which is very helpful. Like I am.

All good evidence.
If you read the Wallentin judgement, these facts don't change of themselves whether the original delay was extraordinary (an engine change is unlikely to be, but a medical emergency probably is). But there is a second test, which is that even if it is extraordinary, the airline must use all of its resources to minimise the delay. Search for Wallentin and the so-called "Third Question" for the detail.0 -

The Court gave you a deadline to submit your respective bundles? And Thomson are now beyond this? By how much?
Write to the Court Manager to complain, and ask that this be brought before the attention of the judge. Regrettably most judges don't seem to care too much - but a few will strike out a defence if there is no good reason for the delay in submitting. At the very least, it shows the airline behaving badly.0 -

Unfortunately a Judge only really sees the file on two occasions - at directions questionnaire stage and at final hearing. Unless you draw the court's attention to a failure to comply a DJ will often not be aware of it.
It depends on the specific wording of the order - some Judges make provisions for penalties if people don't comply, such as not being able to rely on cases. That often isn't the case in small claims matters though.0 -
Just wondered if anyone tried to get compensation for delay to TOM 530 Manchester to Dalaman on 27/5/2010 and return flight TOM 531 on 3/6/2010. These flights were delayed by 6 hours and 8 hours respectively. On return from my holiday I complained to Thomson about shabby treatment especially at Dalaman airport where everyone was just dumped airside. At the time I was fobbed off but unfortunately do not have a copy of Thomson's response.
It has always seemed likely to me that there was an operational issue not a technical one considering the same flight suffered severe delays in consecutive weeks; or just unlucky.
Any comments or advice re claiming now would be appreciated.0
