    Cheers -Is it worth getting it in the court sytem now

    I would personally because, if I understand where you are you still need to send your NBA, then give them time to respond before issuing your claim, etc.. May/July will be here before you know it!
    will they just put the case on hold anyway?

    They will presumably request that from the court.

    Great thanks - will issue the NBA and see where we go from their. Like you say it'll be here before we know it!
  • I was delayed by 3.05 hours from spain to the UK on the 22 dec because thompson had count 346 bags and only has security clearance for 345, so they had to remove all the bag and count them again and found they had counted incorrectly.

    Does this qualifiy? It appears to qualify to me. If it does I will get the letter in the post tomorrow.

    I've finally got round to responding to Thomson, I see why some ppl are using the claims companies, it time consuming reading all these forums lol, quick Q... What does NBA stand for?

    Also, they havent asked for it but for court will I need proof that I was on the flight, or would it be up to them to prove I wasn't on the flight? Has anyone had this problem (claim is for 07/2008)
  • NBA = Notice before action. In the trade we call it a letter before action.
  • On our return flight from Antalya Turkey (Thomson TOM513) We arrrived at airport @2.35pm 31/7/12. took 1 hour for rep to arrive. @5.30 we boarded coaches to take us to hotel. dropped us off at wrong hotel. got to Kerannasary at 6.30pm. kept having meetings every 2 hours. told we have early moring call for breakfast Flight was grounded due to mechanical fault. we didnt fly until 11pm 1/8/12 got into manchester 5.30am. TOTAL DELAY 35 HOUR. I had to ring up work and explain to get another day off on holiday. 3 in our party Myself(gluten free), wife and son aged 7 at the time. Spolit a great holiday. i wrote to Thomson. got a response but no compensation. travel agents tried as well with thomson but no luck. Can you help?

    Was this a default decision by AESA as Coby has described above or an actual decision based on the facts presented to AESA from Thomson's?
    If this is the latter then you have a very useful piece of evidence that should be presented as part of your evidence bundle when....as you have been advised, you take Thomson's to court.
    Thomson won't pay out on this decision alone, but if the decision is one based on evidence presented to AESA then it becomes more difficult for Thomson's to argue against.
    In my case (different airline though) an evidence based ruling from AESA played a big part i'm sure in helping me win my case.
    Successfully sued Ryanair in 2013/14...and have been 'helping' litigants since then.

    DW in my case (v Monarch) my Judge stated that in his opinion the supportive letter I had from AESA was a total waste of time and not even worth the paper it was written on!
