Hi there has anybody else had a phone call from thomsons to apologise for the delay on flight tom195 19 hrs delay and they say no compensation due to US aviation authorities?

Would help if you posted on Thomson thread and provided the date. Whilst the flight number will give some an idea of the route the departure/destination airports may well assist if mentioned in post as well as heading.

Perhaps best to get that reason in writing from Thomson, and then make an assessment of what, if anything, to do next.
Posts are not advice and must not be relied upon.

    Dear All,

Just received my cheque for £922 from my neighbour. Thomson had sent it to number 23 instead of 27 in my street!! A final last tactic to avoid payment perhaps!!

Excellent news with publication of the Huzar judgement, if I had this in my bundle I think the EC part would have been much easier for me to prove but never mind.

This new tactic with mediation appears yet another bluff and I would not be handing over any money for mediation - as other have said its a statutory claim you are making not a dispute eg quality of workmanship etc.

Massive thanks to everyone on the forum who helped me with this case. I will try to repay the favours! Anyone considering claims then go for it, no point in sending letters to them forever. The only way to hit these people is to choose your airline wisely in future, other family members have taken their business away from Thomson now - probably 10K this year to other companies. This is the only way they will change ultimately. I will never be using Thomson again, they are liars and thieves.
  • Hi,

Just wondering if someone could advise whether our case is worth pursuing?

We were delayed by over 3 hours on a Thomson flight from Geneva to Gatwick in Jan 2012. No official reason was given, but we overheard the cabin crew saying that the plane would have to wait for all Thomson passengers who had been delayed on the way to the airport due to heavy snow in their ski resorts as ours was the last Thomson flight of the day. There wasn't a flake of snow at Geneva. There was extremely heavy snow in our resort and our own transfer coach to the airport had left 2 hours early to allow for the snowy conditions.

Thomson have written back saying that the delay was caused by EC - the relevant paragraph of the letter is:

"I have checked our flight reports and can see your flight was delayed due to adverse weather conditions which caused coaches getting to the airport experiencing extremely difficult driving conditions due to road closures and heavy snow. Therefore the decision was made to delay their aircraft for these passengers. Therefore the cause of this delay sits under Extraordinary Circumstances, as it was due to meteorological conditions."

I'm not convinced, but would appreciate any advice.

    Thank you

Like Centipede said. NO EC there. As we know alpine resorts usually know well in adavnce down to the last 1/2" where and when snow will fall. Everyone should have left early from resort, like yourselves.

Not strictly true, you could waste a lot of time and effort and lose your court fees.

    Have you read the FAQs?

What's a "rest bite", by the way?
