Congratulations - great result! Just wondering if this is from the flight in 2008? Did Thomson write a letter to the court asking for it to be stayed (before they decided to settle obviously!)? Thanks0

Wondering if anyone can help. I've got a hearing against Thomson coming up at the end of the month, after 1.5yrs in limbo (our case got lost by the courts!).
My claim and Thomson's defense were submitted last year sometime and we've just exchanged witness statements (which is in its self enlightening as I suspect their EC argument wouldn't hold just based on their own evidence!). I've just seen the Huzar judgement and would like to rely on that in my arguments (along with the other DJ cases that someone mentioned a page or two back if needed). Do I need to make Thomson/the Court aware prior to the hearing that I'd like to use these judgments?
Or do I just take copies with me to court and hand them out there? I suspect the judge would prefer if I exchanged anything I'd like to rely on earlier rather than later but wanted to see what others have done/what is actually the done thing!0 -
Send it to the court in advance, copied to the airline, and take an extra copy or the judge on the day.0

Due to work commitments, I've been out of sorts with the latest developments, apart from Thomson seemingly coughing up s**t loads now!
The excuse given by them initially were not EC (our flight was used as a rescue flight to pick up 'stranded' passengers at another airport on the return leg of our holiday).
Sent the initial letter(s), with the usual NCB letter(s), only, a couple months back, them saying that they had investigated and the 'root cause' on the delay was something relating to security and unaccounted baggage, and therefore being told we could not claim.
Our total delay I think was just over 4 hours, and maybe only a quarter of that I estimate was the 'root cause' explanation given.
So we've been on ice since.
Has anyone been in a similar situation?
Any advice if it's worth persuing with them, citing (what?) evidence?
Or, just handing the reins over to a no win no fee (and if so, any recommendations...there's a thread on eu claim, which I've not fully read, but starts off rather disturbingly).0 -
Hi Kew73, Yes, this was from our flight in 2008. However, I did claim in 2008 and Thomson replied that we were not covered as on a 'package holiday'. A blatant lie, compounded by the fact that Thomson have changed their defense several times. It was just fortunate that I had saved all my notes and correspondence from 2008. :rotfl:
Shall we gather evidence from all those with whom Thomson have chnged their defence/ Then approach CAA and insist on enforcement.
In my case Thomson signed the Statement of Truth with a n erroneous defence which, when disproved, they altered. If shown to be chronic this is an abuse of Court process.0
