    Put my claim in about two weeks ago and received an acknowledgement saying they will contact me within 28 days.

    Anybody else on this flight?

    I am sure they gave us a letter for insurance purposes, but I can't find it but have found the luggage claim tag and luggage tag itself. Plus I've got all the booking confirmations.

    After the 56 days with no reply, what number Re you guys calling? My 56 days are up soon and expecting to have to call?

    A lot of people on this thread ought to read the FAQ's sticky really, and commence court action now with a NBA letter.
  • My nephew called Thompson 15th Feb and was told a form would be sent to him. It is now 27th and no form has arrived.

    I sent a claim at the end of Dec 12 to Thomson for a 4 hour delay to malaga in 2008.

    I chased them up on email asking for a reply, and basically they are saying they rejected my claim because it is more than 2 years ago. Is this correct ? What shall I reply ?
    I did write to them at the time complaining about the delay, is it worth bringing this up with them perhaps ?

    The particular paragraph they state is below

    "The European Court of Justice has confirmed that, as the Regulation doesn't say how long passengers have to bring their claims, we need to look at our national law. The Supreme Court in the UK has said that all claims to do with "international carriage by air" need to be brought within two years. We, therefore, can't consider claims for flights that were delayed more than two years ago."

    Any help would be gratefully received?!
  • I've had the same reply saying that as my delayed flight was over 2 years ago I'm entitled to zilch!! Seems its a standard reply but not really sure where to go next?
  • 22 hour delay on a Gatwick Male flight on Jan 6th 2013.

    Jan 28th 2013 telephoned First choice /Thomson complaints dept.
    Thomson representative told me it was company policy not to compensate for flight delays but would take details of the appalling treatment / accommodation provided by the company.

    Jan 31st
    National press reports on successful case won by English teacher against Thomas Cook for 22 hour delay Tenerife flight. Quoted application of the EU law that says companies must compensate for delays which are 'their fault'.

    Feb 11th
    Telephoned First choice /Thomson complaints dept. Thomson representative told me that as I had now mentioned the EU legislation that they would now pass on my case details to the Thomson Flight Delay Claim dept!!! I told them that I was appalled by their business practices and they said they could not help clients make claims against them.

    Feb 27th
    Claim form had still not arrived and I telephoned again told them how unimpressed I was. Received email containing the forms. Interestingly it is actually the same dept that handles complaints that deals with claims. Flabbergasted!!

    Further point of interest - I have one booking reference for 2 people but I must complete 2 claims forms with identical information and presumably same evidence.

    I've just submitted a court claim against Thomson. We first wrote to them Oct 23rd 2012, then waited until January for them to issue claim forms, filled those in and sent back and ........................ nothing!!! Sent 14 day notice of action ........... nothing! Issued online claim.

    I've been reading a lot of forums and haven't yet found a post of a sucessful claim against Thomson without Court action being involved.

    My advice don't mess about being as patient as I have, if you've got a valid claim give them notice of action and file to the courts. The claims are allegedly being dealt with in 'strict rotation' whatever that rubbish means, well I guess now mine will go to the top of the pile when they receive the court papers.

    TUI never again will I give you a single penny of my money when you can't even give my the courtesy of a response!
