    56 days up today. Have just spoken to them on the phone. They say they are aware that they have gone over the 56 days but are working through an enormous back log. I asked whether anyone's case has actually been dealt with yet and they said yes, some people have already had their claims dealt with. It would be great to find evidence of anyone who has been successful. Anyone out there?

    There's at least one on these forums I've seen.

    I'm holding fire with the NBA and court action until I've seen their response - always better to have all information at your disposal particularly if they contradict themselves.

    All they've done is go to great detail about what happened on a previous flight that day. It's within their control to have swopped planes and made sure you took off and arrived within the 3 hour delay window.

    Right we have decided to take a more robust approach with Thompson. Fired off the letter giving them 14 days to pay. Not sent it by recorded. I am sure they will get it but if they choose to claim they haven't that's up to them. After 14 days we will sent the NBA. Again not by recorded. If they ignore that then we will issue a small claims. The courts don't send their paperwork by recorded so I assume if Thompson ignore two of our I recorded letters then they will ignore the court papers.

    Errr... that's not very 'robust', is it? 14 days to pay as part of an NBA is the course of action.
    Not a letter now, and then another one.

    Hi.
    We were delayed 24 hours coming back Sharm-Manchester at the end of August 2011. After 2 initial rejections I was then sent the forms to complete but so far no reply and my patience has worn thin. The reason we were given for the delay is that one of the pilots headphones was broken and the spare had to be flown in from UK as no one in Sharm could fix it. My only niggle before going down the legal route is that I am sure Thomson will seek to use flight safety as a defence and thus an 'extraordinary circumstance'. I am mulling over getting a ruling from the CAA which I appreciate will take months but could help/hinder. Thoughts on this?

    The only sucess I've seen on this forum with Thomsons is one case which involved the claimant issuing small claims and they were successful.

    11 weeks yesterday and still not ONE word have I had back from them. I have now sent the papers to proceed with court. It's an absolute joke the way they are treating people. I rang again today took me 35 minutes to get through and still nothing has been done. Here's hoping it will be sorted really quick now that its in the hands of the court. I have told them on numerous occasions that I was considering court action and they did not care. I have just booked flight to go away next month. I did not book with Thomsons no chance no way.

    I too have just had a reply from Thomsons saying they are not considering lights over 2 years my 10 hour delay was in May 2010. So off to small claims i suppose we trot. Obviously before i will send 'a before court' letter giving then 14 days please could someone link me to a letter to send if their is one.

    So the letter starts off tlling them what i am claiming for then the last parargraph states that i will proceed with legal action against them if they comply (so to speak). Are they correct when they say that the European court did'nt stipulate how far claims could go bak so Thomson are using UK law?
