    Being blunt tell Thomson to take a running jump with regard to their 2 year cut off point. They will be claiming 2 minutes next.

    Read FAQ's Notice Before Action - letter giving airline 14 days notice that if they don't pull their finger out you are taking them to court - mean it don't just threaten.
  • Hi all :)

    So I took a flight with Thomson May 2007, which was delayed or cancelled, I couldn’t remember – I was either put on a later plane from the same airport, or sent to Bristol in a taxi with some other people. There were two separate occurrences, and this flight was the only one of two I took from the airport in question looking at my emails…I used to travel a lot.

    I went through Thomson to make my claim, was told they’d get back in touch in 56 days, a month after this deadline, I heard nothing, so I was forced to file a claim before the 6 year deadline was up.

    Now they’re claiming the plane was 10 minutes delayed, which must mean I was denied boarding because the flight was full, right? I defo didn’t do anything wrong, and I remember something about this denied boarding. It WAS six years ago.

    There is no info on flightstats. Further, I have asked Thomson to verify for themselves from the passenger manifest that I was not on the plane, and whatever records they have to show when they send passengers to a different airline/airport. The one thing I am certain of, and I would not have begun a case through MCOL otherwise, was that the delay was about half a damn day to get where I was going. So I am definitely entitled to my 250 Euro.

    Thomson now saying the onus is on me to prove I was not on the flight/was denied boarding. The whole thing seems suspicious to me…no flightstats, not responding to my request to investigate (thinking I would go beyond the 6 year limit I reckon), etc…

    So I filled my allocation questionnaire yesterday…

    Thoughts, you cool mofos?

    My thought is that your claim will fail because - if your flight was in May 2007 - you are out of time, are you not?

    If you don't know the exact circumstances yourself it seems very risky to take the case forward.

    Firstly you can make a request to their data controller to provide you information of that flight, they should keep it on record, even from 6 years ago. You will have to pay a fee for them to provide this information (Maybe £10), but they can do this, which will give you access to the passenger manifest at least, you'd then only need to prove you made a booking for that flight and Bob's your uncle.

    You state in one of the cases that they taxi'd you and others to Bristol, where I assume that they flew you on the next available flight, however you have to remember if this is that case, did you volunteer to go from another airport, in place of other benefits? I.e. did they offer you money/vouchers etc. If you volunteered to go from another airport, then it is not denied boarding.

    Does anyone have a court date coming up.I filed my allocation questionaire last week so back to the waiting game for me

    I commenced a compensation request in November 2012.

    I have sent an NBA in May and am going to submit a MCOL.

    However, the only letter I have received from Thomson is acknowledgement of my initial compensation request letter. Thomson's reply was basically a 'we have received your request. Please complete our official forms'.

    Their reply to the official forms was a telephone call to my father in April (I am complaining on parents behalf) stating that due to a bird strike causing the delay, this is EC, so no compo.

    They have not followed this up with a letter.

    They have not replied to the NBA.

    As such, I have very little correspondence from them to use to build a case.

    From reading this forum, I know Thomson aren't the best, but the lack of written replies seems odd.

    Has anybody else been in a similar situation?

    Not that odd, in my view, that Thomson have been silent. The status quo suits them, after all! You'll need to start a court action to get their attention, I suspect.

    Thanks for the reply.

    I just expected some formal confirmation that they weren't going to pay X because of reason Y and that is that.

    I guess even this is too much to expect then!

    I have received a response from Thomson this morning stating the reason for our delay was extreme weather conditions which comes under the heading of Extraordinary Circumstances! However on the flight stats web sight it does not mention anything to do weather it states - (we have one or more data sources for this flight, but we encountered a technical problem whilst trying determine the final status).

    I raised a MCOL yesterday, do you think I have a case or should I give up? Any advise would be much appreciated?
