    has anyone give the claim to eu/bott to deal with? If so how long long do they take any ideas? X

    A few pages back someone said a Claims company has given up when the airline came back with the two year rubbish, so I wouldn't bother with them.

    EU Claim/Bott Solicitors seem to be getting some results but my impression is they (all) cherry pick and look for the easiest cases. The speed at which they or indeed anyone works is based upon the time taken by the Court to list your hearing - it is not in the hands of a claim company.

    I think this has to be right. I understand that Monarch airlines, for example, has had over twenty thousand claims - and they are a relatively small outfit. So my betting is that the NWNF industry is currently saturated: the companies can thus pick the low hanging fruit that maximises their return for the least possible effort.

    That's why I suspect a number of people with seemingly genuine claims have been given the "thanks but no thanks" response.
  • We are wondering what is the best thing to do, so would appreciate any help.
    We have written to Thomson regarding a delayed flight in Sept 2011, we were delayed at M/c airport for just over 5 hours for a flight to Ibiza. We were told (after about 3hrs and complaining loudly) that their was something wrong with a small part on the plane and another one had been sent for, when that finally arrived it was the wrong part (surprise, surprise) so they sent for another plane. Eventually that arrived and we took off without any food or drinks on the plane as the pilot, who wasn't happy, said if we waited for refreshments we would be even longer taking off.
    We received a reply from Thomson yesterday and it was the same waffle about extraordinary circumstances etc. etc. that went on for 4 pages. What we want to know is what do we do next as we don't think receiving the wrong part of the plane was down to "extra ordinary circumstances", human error yes.
    Also we were wondering if anyone else has claimed for this flight TOM 2322 on 14th Sept 2011 to Ibiza from Manchester.
    Sorry for the long post but any help would be greatly appreciated. Oh and should we mention that as I am in a wheelchair (as were others) it was very uncomfortable being stuck their and shuffled from pillar to post for 5 hours.

    Most definitely not an EC.
    Pursue a claim they will give in if you are firm with them if all else fails Issue a NBA letter.
    They will give every excuse they can
    We did and they settled out of court.
    It can be time consuming but my attitude is my time cost nothing

    I am sorry but the last sentence ("It can be time consuming but my attitude is my time cost nothing") puzzled me and made me smile.
    The whole concept of the EU ruling is based on the fact that your loss of time is valuable.
    If you truly think your time costs nothing why are you bothering to claim?

    My claim was partially because I thought the airline should pay for their lack of respect both during and after the delay shown to me and my fellow passengers and the only way to deal with this through the UK courts is by way of compensation and having sorted this aspect out (and as my time costs nothing as well) I decided to donate the proceeds to Charity then at least someone benefits from time I have spent on my claim :)

    my claim is off 11 months ago not over 2 years z

    me and 5 mates were delayed 4 hrs last year with thomas cook phoned them today and are sending a cheque for 80% of our money back:beer:

    so i phoned thomsons up who my wife and 1 and 2 others were delayed way back on 21/12/2006 they just fobbed me off saying they only pay for last 2 years and when i gave her dates we went she said can't find our names that day but might be because they have merged with 1st choice since then and said only way we can do anything is see a solicitor but still won't get anything unless we have a letter about our complaint in 2006/7 :mad::mad:
