    Hope you didn't issue it to Tui, they are the parent company, should've been issued to Thomson Airways.

    Agreed. They'll defend on the basis that it's got nowt to do with them. And they'd win, I reckon.:(

    as long as you name the airline and bracket TUI I dont think it matters, if youve sent letters to that address, then use that for service of papers. mine was with First choice, but its TUI who you deal with at that address,

    Hi All, I am just sending my NBA and was looking for a little bit of advice, we were delayed from Corfu to Luton. We were scheduled to leave at 2205 on 13/6/08 and arrive at Luton at 2320. We actually flew at 0930 on 14/6/08, we where flown to Gatwick (we landed at 1030) and then bussed to Luton, eventually getting there at 1400. When we landed at Gatwick we were given a letter stating the flight delay was due to technical problem in Norwich and a new crew and aircraft had been sourced at the earliest convenience but was need in Gatwick.

    Now do I count the length of delay until we landed at Gatwick or arrival at Luton?

    Although that wouldn't be the end of the claim. When a claimant realises they've sued an incorrect party, they make (and pay for) an Application to substitute the defendant with the correct party, which is normally approved. Then the claimant crosses out the incorrect party in red and substitutes that name with the correct party, also in red - guidance on that is HERE.

    You were delayed more tha 3 hours so you can claim 300 Euro each. If the delay was not a strike, bad weather political unrest etc it was not an exceptional circumstance.
    I take it you were given accommodation and meals etc as you were delayed overnight. If not you also have a claim for a hotel if you booked in one and cost of meals. The airline have a duty of care and irrespective of the cause of the delay you should have been given these.
    There fore make a claim if you get a rejection send a NBA letter with all the facts.

    No, we were taken to a restaurant that was closed, for a meal that was disgusting, I think it was the leftovers from the days menu, it was cold, they did also provide us with one cup of coffee. They never told us how long were going to be delayed for, they just kept saying the plane was on its way.
    I don't have receipts for any of the things we bought in the airport.
    I have already sent a letter to make a claim which they said 28 days. I have given them 21 days due to bank holiday but I am now sending the NBA. I just wanted to know if I counted the delay from landing at gatwick or whether it was the intended airport (luton)

    It would be total time to Luton, the airline is obligated to get you to the place you were supposed to be going, not just where it fancies!

    I was just wondering, what is the difference between a delayed flight and a cancelled flight? my husband thinks that our flight is classed as a cancellation?
