me and 5 mates were delayed 4 hrs last year with thomas cook phoned them today and are sending a cheque for 80% of our money back:beer:

Why only 80% your entitled to either 300.00 400.00 or 600.00 euros.
depending on the length of you delay and length of your flight.

My claim was partially because I thought the airline should pay for their lack of respect both during and after the delay shown to me and my fellow passengers and the only way to deal with this through the UK courts is by way of compensation and having sorted this aspect out (and as my time costs nothing as well) I decided to donate the proceeds to Charity then at least someone benefits from time I have spent on my claim
Also being trapped airside for several hours is not a great deal of fun.
I must say that your decision to donate your payment to charity is very laudable and I wish you every success0 -
So, to clarify: I can claim from 2005...but not more than 2 years? I have read page after page on this thread and still not one clear post. I have submitted a claim on 03/06/13 for my delay which was back in 17/10/10 flight TOM866. If or when i get the standard response do i go the court route or is my claim dead in the water? I was delayed for more than 4 hours on a flight to mexico so meet all the criteria for compensation.
My head is spinning from all the conflicting posts on here does anyone have a definitive answer on deadlines etc0 -

The 2 years limit is what some Airlines are pulling out of their backside from the Montreal Convention, which isn't relevant. Basically a ploy to try and prevent people from claiming.
Claims are valid for 6 years from the date of the flight, which is the Limitation Act in the UK.0 -
Hi im am wondering what is the best thing to do, so would appreciate any help.
i have written to Thomson regarding a delayed flight in Nov 2012, we were delayed at Gatwich airport for nearly 24 hours for a flight to Mexico. We were told that their was something wrong with the cockpit window after it had been struck by lightening and new replace part was on its way for it to be fitted, anyway after 3/4 hours they decided it wasnt going to be able to fly and another plane from Birmingham was on route to us, and this would delay us even more. Once the second plane arrived it had developed another fault causing the second plane to be delayed again! After more hours of delay the plane was fixed and ready to fly, but as things seem to progress we were hit with another bombshell that the planes crew wouldn't be able to fly the plane due to flying hours and we would be have to wait till the morning to board our flight!
ive received a reply from Thomson and it talks about how they were extraordinary circumstances etc.
What i want to know is what do i do next? Do i continue the claim?Do Airlines have standby crew for such an event?

Basically I would cut through all the rubbish, issue them with an NBA and at the start of July complete the court claim forms - assuming they haven't seen sense by then!0 -

The statue of limitations in England is 6 years. So even though the regulation is effective from 2005, as you invariably have to take legal action to get compemnsation, if LEGAL claim is not brought within 6 years, airline can just laugh in your face....

Yes as far as the 6 years part is concerned, i was more referring to the 2 years cut off point that Thomson seems to be trying to enforce?0
