    Why only 80% your entitled to either 300.00 400.00 or 600.00 euros.
    depending on the length of you delay and length of your flight.

  • So, to clarify: I can claim from 2005...but not more than 2 years? I have read page after page on this thread and still not one clear post. I have submitted a claim on 03/06/13 for my delay which was back in 17/10/10 flight TOM866. If or when i get the standard response do i go the court route or is my claim dead in the water? I was delayed for more than 4 hours on a flight to mexico so meet all the criteria for compensation.

    My head is spinning from all the conflicting posts on here does anyone have a definitive answer on deadlines etc

    The statue of limitations in England is 6 years. So even though the regulation is effective from 2005, as you invariably have to take legal action to get compemnsation, if LEGAL claim is not brought within 6 years, airline can just laugh in your face....

    The 2 years limit is what some Airlines are pulling out of their backside from the Montreal Convention, which isn't relevant. Basically a ploy to try and prevent people from claiming.

    Claims are valid for 6 years from the date of the flight, which is the Limitation Act in the UK.
  • Hi im am wondering what is the best thing to do, so would appreciate any help.

    i have written to Thomson regarding a delayed flight in Nov 2012, we were delayed at Gatwich airport for nearly 24 hours for a flight to Mexico. We were told that their was something wrong with the cockpit window after it had been struck by lightening and new replace part was on its way for it to be fitted, anyway after 3/4 hours they decided it wasnt going to be able to fly and another plane from Birmingham was on route to us, and this would delay us even more. Once the second plane arrived it had developed another fault causing the second plane to be delayed again! After more hours of delay the plane was fixed and ready to fly, but as things seem to progress we were hit with another bombshell that the planes crew wouldn't be able to fly the plane due to flying hours and we would be have to wait till the morning to board our flight!

    ive received a reply from Thomson and it talks about how they were extraordinary circumstances etc.

    What i want to know is what do i do next? Do i continue the claim?Do Airlines have standby crew for such an event?

    Any help would be greatly apppreciated!

    Basically I would cut through all the rubbish, issue them with an NBA and at the start of July complete the court claim forms - assuming they haven't seen sense by then!

    Yes as far as the 6 years part is concerned, i was more referring to the 2 years cut off point that Thomson seems to be trying to enforce?
