Ive had one claim approved for compensation from TC and another one just rejected on the grounds that it was a manufacturing fault with a part they replaced!
Has anyone asked TC for the aviation report to prove what they are saying or should i just accept what they have said?

Hi Hev, yes had the same response and in my NBA asked for a copy of the aviation report to which they were referring to under the terms of the court pre-action protocol. Gave them a generous timescale for response and deadline passes on Monday, so looks unlikely I'll be getting a copy of this report.
Interestingly it appears my flight was delayed as a knock on from the incoming flight being late, so the manufacturing fault sounds bogus to me and as others have pointed out it seems to be TC's latest favourite fob off!0 -

Just a quick update actually got around to phoning TC yesterday and to be fair spoke to a really nice guy,full of apologies and also he advised me that £960.00 was heading or way in the next 14-28 days.Also he did say we could have the voucher,but if we preferred we could have cash instead.Now i finally got an answer waiting a few more weeks really don't bother me - but tell you what ...love this site i would not have thought about claiming only for reading other peoples stories.And anyone out there stick with it don't give up!!!!

Good Morning All,
After a telephone call to the Case Management team at Manchester CC I was informed that they do not know who or how often the Administrative Court Office email is checked. And to forward my request for my stay to be lifted on to them.
This morning I have now received a letter from the Judge that the Defendant has 28 days to place in writing there reasons for not paying the due compensation. Upon which time further directions will be made. If they fail to respond yet again I can request judgement.
Why has he not lifted the stay?
This has been dragging on now more or less two years and has become exhausting. In there defence they admit 2 technical failures as reasons for the huge delay we had. Neither of which are exceptional as per the Supreme Court judgement.
I just want compensated or my day in court to get this over and done with.

I am begining to think legal aurgument cases may not be needed in court bundles as the judges are well informed on this now as the cc state "Airline judge". We shall see in my directions from court expected soon.Check out Vaubans Flight Delay Guide, you will be glad you did....

I was slightly less successful with my phone call.
As it has been suggested in the thread my reply to TC's email stating I'd be paid within 28 days has been ignored.
Getting a tad irked I thought I'd phone instead. If you follow the options through and enquire about an existing flight delay they direct you to their website and then cut you off. I did this and effectively you are simply filling out an online form which is the equivalent of an email asking them to get back in touch with you. Again this appeared to be ignored.
So I phoned again yesterday and chose the "any other enquiries" option at each turn so I could try to speak to someone.
The Gent was polite and helpful enough explaining the volume of cases they were going through, that mine was in a queue and giving me an estimate based on the queue position.
A bit waffly and vague but at least I have a further timescale in my head before I starting contacting them again0 -
Would appear that TC fit a great deal of faulty parts to their aircraft, given the number of times they are using this pathetic excuse.

Hi All,
looking for a bit of advice please. It's regarding a flight from May 2009. I have already lodged my complaint, earlier this year, and it was held up etc until the case was settled. I got another confirmation email that they were looking into my case in early November. I requested further information mid-December, but received no response. I issued a NBA via email on 23rd December, again no response. I telephoned last week, but again, they couldn't tell me anything, other than they would let me know once they had looked through my case (they've had it since maybe April). Could anyone please advise how I now go about lodging a court case? I'm conscious that I may be running out of time if I leave it any longer. Many thanks
Edited to add: I have the flight number (TCX5060), but there is absolutely no record of it anywhere. It was Manchester to Dalaman and I think it was 7 hours delay.0
