    Not heard anything since 21st Nov, last email saying they were reviewing the cases in light of the court ruling yada yada.

    Is there any point ringing them or sending an email?

    First of all, have you sent an NBA (if not, that's your next step).

    In my experience so far the ONLY thing worth doing is phoning them.
    Following the initial email they send, TC do not seem to respond to any letters or emails.
    Phoning, on the other hand, gets a quick response - particularly if you have already sent an NBA and you say you will be submitting your court papers next week!


    Then when they say you are entitled and they send you a voucher via email, ring them again to say you want cash.

    Understand your reasoning......re the distress etc loaded....
    What about the 1992 Package Travel Package Holiday and Package Tours Regulations? which basically state it is the responsibility of the Provider to provide all of the elements of the package contracted for as they were described - in this case 8 nights all inclusive at a 5 star hotel. We are legally entitled to receive compensation for loss of value consequential losses and for the disappointment and loss of enjoyment and distress suffered by all members of the party( 4 in total including 2 little children). This wording is taken from the CAB website pro forma letter for such cases such as my own. Am i really wasting my time with this in Small claims, as it seems outrageous that i pay for 8 expensive nights away and receive only 7 and this is ok!!!

    No, I'm not saying you are wasting your time. That 1992 regualtion (aasuming it is still valid/in force) strengthens your case, IMHO. But it is not as cut and dried as reg 261/2004 (ought to be anyway).
    This forum really is to do with EU reg 261/2004.
    I would still keep them as seperate complaints and claims.

    Ive had one claim approved for compensation from TC and another one just rejected on the grounds that it was a manufacturing fault with a part they replaced!

    Has anyone asked TC for the aviation report to prove what they are saying or should i just accept what they have said?

    You can ask but you will not receive. Do not accept what they say - sounds like you need to take court action.

    Not sent the NBA but will do first thing Monday. Thanks. :beer:

    recently delayed by 27.5 hours from Gambia with TC it was some kind of political unrest (had knock on effect for dog in kennelss, parking etc...) - are we due any compensation for this - cant really follow how the rules are for this type many thanks

    I have had a reply saying the due to the regulations etc etc compensation is now payable for the claim. And have been given the 28 days to wait.

    This is for flight TCX1907 on Nov 2nd 2014 - Dalaman to Gatwick.

    The e-mail also states '...within 28 days and the amount being paid will be confirmed on your payment confirmation e-mail'. So I assume at this point I will be sent a voucher and have to ask for cash.
