    Thanks Vauban for your guide. I rang TC as I thought I might get further than emails. They've now sent me another email saying that the problem was originally caused by low cloud in Corfu and the plane was "subbed" and therefore it's covered by exceptional circumstances and wont be compensating. Do you think it would be worth going through EU claims or am I wasting my time?! Many thanks.

    Substituting the plane was an operational decision, entirely within the airline's control. Therefore not extraordinary at all.

    If you use a decent NWNF company like EUClaim or Bott, you won't be wasting anyone's time but theirs'. So if you lack the inclination to litigate yourself, then of course engage a NWNF company - they won't take it on if they don't think they can win.
  • Many thanks again Vauban. I agree with you completely about them substituting a plane and that's why this is niggling me so much!! It's the principal of the matter! I have submitted my claim with EU Claims as I'm not that confident with pursuing it myself. I hope they will get further than I did!

    Yeah, similar experience here with my last correspondence from Thomas Cook coming on 4th December.

    Having been previously told no compensation was due I went down the NWNF route and have had the claim on the go with them for almost 18 months.

    Out of the blue I received an email from Thomas Cook telling me compensation was now due to me and would be paid, the amount being confirmed in a further email, within 28 days.

    I've emailed them now to ask about the delay and when I might expect payment.

    I'm actually a little unsure on what to do regards the NWNF firm though. Do I let them know? Keep schtum and see what transpires further before contacting them. Don't contact them at all!

    Clearly Thomas Cook's change of tack has been as a consequence of the Huzar case and not through any inspirational legal work from the NWNF firm.

    I imagine they would still be due their fees ofcourse if the compensation comes through them, but what if Thomas Cook send me vouchers or a cheque direct?

    In the meantime I'm watching my inbox with interest.

    Thank you for the response.
    I have read your guide, but I was hoping for a definitive act/ruling that I could actually quote in support of the case.
    However, my dealings with TC to date can only be regarded as professional and correct, so I hope that they will continue in this mode and pay the compensation in real dosh.

    The Regulation says that the compensation can only be paid in vouchers with the consent of the passengers, otherwise it must be cash.

    But the experience of everyone in your position - many dozens of whom have posted it on here - is that if you ask for the money they give it to you without issue. Just search for "voucher" to see the many, many, many, many, many posts on this issue.
