Depends on what actually happened (some third party actions might be extraordinary, such as ATC decisions) - but read my guide and, if you think you're due compensation (you most likely are), then you take them to court.
It was 'damage to one of the aircraft doors' according to Thomas Cook letter to passengers announcing the delay and this was further verbally briefed as caused by baggage handing.
I have come across the Siewert v Condor (C-394/14) Order which suggests that the circumstances of my claim is not 'extraordinary circumstances' since baggage handing is a normal activity.
Wondering whether to have one last shot direct at Thomas Cook with this line before taking a legal route?0 -

If you want to mention to Thomas Cook up to you .... if using a NWNF might be worth one final shot to save you their fees or if going DIY may as well get on with it now.0 -
I originally contacted Thomas Cook back in 2013 and was rejected with the usual 'extraordinary circumstances' rubbish...
After the Huzar ruling i emailed them a few times to re-open my case but never had a reply. Decided yesterday to call them instead and within an hour of my call recieved and email saying they have looked at my claim and compensation is due.
I should hopefully receive payment within 28 days :j
Thanks for everyone who puts in so much time and effort on this page, I've been lucky with not having to go to court but glad that everyone is making a stand!0 -

Hi! I'm new to this forum so please forgive me for any errors etc! I was delayed 6 hours on flight TCX2217 from Las Palmas back to Manchester on 22nd September 2014. I emailed Thomas Cook using the MSE template and after a bit of toing and froing they've said that I'm not entitled to compensation due to extrordinary circumstances (bad weather earlier in the day in Corfu) even though in one of the emails I was told that the delay was due to technical problems on an earlier flight. Can anyone give me advice as to where I stand with this please! I have considered going through EU Claims as they may get further with this but am not sure as don't know what the charges would be if I lose/win. I also had to pay a surcharge on my long stay car parking at Manchester airport due to the delay. Many thanks for any advice.0

Read my guide - everything you need to know is in there. Weather issues in Corfu are irrelevant for determining extraordinary circumstances in a flight from the Canaries to the UK. Sounds to be that you have a slam dunk claim.0 -
TC have just emailed to confirm that compensation is due due to the delay on the above flight.
However they are offering vouchers, not money. Is there not a requirement that the compensation is monetary.
There must be claimants that do not wish to use TC ever again !0 -

Thanks Vauban for your guide. I rang TC as I thought I might get further than emails. They've now sent me another email saying that the problem was originally caused by low cloud in Corfu and the plane was "subbed" and therefore it's covered by exceptional circumstances and wont be compensating. Do you think it would be worth going through EU claims or am I wasting my time?! Many thanks.0
