    Following the ruling preventing the appeal, I asked TC to take my claim off hold. Email received from TC yesterday stating....
    "We will now implement the recent decision by the Supreme Court in the Huzar vs. Jet2.com case on Friday 31 October 2014. This ruling confirmed that a number of technical incidents leading to flight delays can no longer be classified as extraordinary. This is different to previous guidance given by the UK CAA and other national enforcement bodies."

    Yeah, whatever - just process my claim please!!

Even after emailing the court to have the stay lifted. Should I now put it in writing to the court and TC to make them act or wait to see if they process it in due course?

    I rang the Court again to chase up my email sent 3/11 and was advised its going before the Judge today to lift the stay and set a hearing date. Confirmation of date will be sent in writing to TC. The waiting game goes on.....

    If you're case is already in the court system 'stayed' pending the outcome of Huzar or Dawson then you should email/write to the court CC the airlines solicitors asking for the stay to be lifted, - details in the Huzar thread.

    The Court will hopefully start to lift the stayes in place, we're waiting to see what happens, and hope that there will be a consistent approach taken by the Judges across all the Courts.

    That's interesting, let us know if the Judge lifts the stay- fingers crossed hey!

    Do you know if TC were opposed to the stay being lifted in your case though? It does look as though TC have accepted the decision of the SC unlike Jet2.

    It's fair to say, that they should be giving cases already in the Court system a higher priority than any potential new claims.

    No hearing date has been set yet, it got to the directions from the judge after TC applied for the stays and then the 2 stays put in place. I emailed the court via the e filing system at the end of the SC decision they have and its been passed on to the judge. TC copied me in on their response agreed the stay be lifted and they still want to defend and proceed to trial.

    You can put you request to the court via the e filing system as an attachment and you should get a response confirming it's in process. I would phone the court to find out what stage it's at and copy all correspondance to TC. Send email off to TC asking them what's going on or the solicitors acting pointing out they are late responding and this could be breaching the directions of the court.

    I read an article this morning and the CAA state that the Airlines should be lifting the stays automatically and if not the Judicial system will be.

    As we have all come to realise you cannot trust the CAA to be taken seriously by anyone especially the airlines, don't leave anything to chance and follow up yourself.
