Finally after over 2 years (and 2 children) TC have agreed to settle out of court as my solicitor wrote to them last Friday offering a deal of 3% interest plus costs instead of 8%.
They practically bit his hand of and I should have the cheque by the end of the month.
Still will never fly with them ever again though. Cheers everybody!0 -
TC are telling the court untruths about the cause of the delay, I know exactly what it was but not told them yet, how do I confirm from TC what the real cause was? The way I see it I will need to argue with them about the real cause and produce my evidence, just wondering if this will be a pre hearing or on the day.Check out Vaubans Flight Delay Guide, you will be glad you did....

If you have a document that you want to rely on then this must be disclosed to the court and the other side in accordance with the judge's instructions or it will otherwise be inadmissible.0

Exactly, you will have to include all your evidence in the court bundle and so will TC in theirs, doubt very much if their will be any kind of pre hearing. You will have to back up your bundle of evidence on the day by possibly being cross examined by their legal team, you will also get the opportunity to question TC about any evidence that they have submitted, the Judge hopefully will be in a position on the day, to make a judgement on who's evidence is the strongest.
This is highly artificial anyway, they are starting to settle cases batman, so fingers crossed :beer:After reading PtL Vaubans Guide , please don't desert us, hang around and help others!
