Celebration we have just received an email from Thomas Cook to say they are sending a cheque for £1244 in relation to our delayed flight 24th June 2013 TCX315 .

    Our perservation has paid off.

Well done! Do post in the Court Success thread!
  • I've been patiently waiting to hear back from the court about my request to have my case reinstated, but to my absolute surprise, after 1 year and 2 months, Thomas cook has finally admitted defeat and I received a letter stating they are willing to pay our compensation, all £1,200 of it. All without having to go to court which I was all geared up for! Never mind, a wins a win ;) good luck everyone else!

  • Cheers Novice Angel,Still unsure what to do as what Thomas cook said was that because the adverse weather they could not get the door open to the plane & they used de-icer & heat lamps.

Hmmm, either that or the door suffered a mechanical problem and the door jammed, try researching weather data and seeing if their story is likely, or offer it to a NWNF solicitor, see if they will take the case and do more research for you. The problem is you won't find out for sure of the true reason until you commence legal action, then if they submit witness statements that testify that the door was affected by a severe weather condition then you obviously won't have a case, sadly.

For the cost of a Court fee, you could start proceedings, then look at their defence and if need be, withdraw the case if it looks hopeless.

I think this is very suspect. Aircraft are exposed to extremes of temperatures all the time - and are built to resist these. I suspect a technical rather than meteorological problem.

As you've been previously advised, the way to check this is to look for how many other flights departed on time from Manchester that day. If most did, then the problem was with your plane rather than the weather.
  • Hello All,

I am currently in the process of claiming via Bott and Co for TCX 2515 HRG - MAN 25/4/14, just wanted to know if anyone else on this flight has received a pay out yet?

    thanks

Here's hoping I hear soon too, we were delayed in July from Florida, so good to hear you've had success and hope we might get some luck soon too.
