    yes i know its per person, you mis-understand me... i said I assumed it was €600 per person (length of flight dependent) RATHER than a voucher.

    What the poster earlier should have received was CASH and not a voucher to the value of.

    So instead of £2616 as a voucher it should have been £2616 as a cheque.

    YES, I did misunderstand you, you can insist on a CASH payout, you DO NOT have to accept vouchers!

    Ask them for a cheque!

  • I have asked them for cash and they said I can have a bacs payment, they said verbally it was 600 euros and now there saying 400 euros as its not long haul. It is over 3500km from lgw to sharm and it was over 3.5 hours

    Go back to them and quote the regulations of EC261. The actual wording is in Vaubans guide

    How long were you delayed at arrival in your destination? Time doesn't matter normally, provided it's over three hours. But if you are traveling on a route in excess of 3500km, and you arrive more than three but less than four hours late, then the airline can reduce compensation from €600 to €300 per person.

    I have previously attempted and failed in my compensation claim against Thomas cook last year.

    I was given a 'technical failure, of a broken fan blade' as the reason.

    I followed all advice from this forum, x3 letters to T.Cook and also CAA, who decided compensation was not due.

    So following the new ruling this year I sent another letter, over 14 days ago (recorded delivery) but have had no response from TC.

    So I am going to go ahead with the small claims court (Scotland) proceedings.

    Can someone give me any direction in how to go about this, correct procedure to take?

    Should I re-contact the CAA once more to see what they conclude, (am I required this for court?)

    Any advise and help would be great thanks.
