(I'm really sorry, I'm not usually so dense, but legal-speak has me going around in circles!!)
I appreciate the time you've taken to respond - thank you. Thomas cook have mentioned nowhere that it was in full and final settlement. Their customer service team informed me over the phone that this was a "pre-emptive settlement" because I believe there was 4 flights affected by massive delays on the same day.If you're new. read The FAQ and Vauban's Guide

Hi we were also on flight tcx163 which was delayed 30 hours. We took this up with the CAA after being rejected by TC and they confirmed the airline weren't to blame. Just wondering if anyone else managed to get compensation for this flight? The CAA did advise compensation for the outgoing flight tcx162 was payable by TC however we are still awaiting them making an offer!! If anyone else was on that flight it is worth making a claim.0

1) Should be on Thomas Cook thread
2) Forum advise is to think VERY carefully before you involve the CAA0 -
Just read that Huzar won his landmark case against JetBlue today. Yayyy. What now? I have had my case stayed, not sure how to proceed as Jet Blue are appealing.0

Like many on here, my case was stayed with TC having to write to the Court to re instate within 14 days of judgement.
I am writing to TC today asking them to confirm they are doing this and reminding them of their Barristers words in Court (taped) that he would be strongly recommending T Cook settle if the Huzar/jet2 case didnt go their way.
If they dont do this within the 14 days, i will be writing to the Court bringing T Cook breach of court order to their attention and asking for it to be re listed myself.
I was on the las vegas flight that got bumped for the Cuban flight manchester airport on the infamous GYMOT plane.
Ill keep you all informed. My case is either re listed for hearing, or, ill get a sensible offer of settlement.
Good luck all.

Good luck Ju: I think you should definitely press this in the way you describe, but perhaps simultaneously (ie approach both the airline and the court - the interest of the latter might focus the attentions of the former!)0

Good luck Ju!! I was on G-OMYT a day before you - mine was the 23 hour Cuba delay.
Are you aware of the Facebook page ran by passengers of your Vegas flight?
We've conatcted the TC solicitor that is representing them in our battle with them for this compensation to ask if TC still intended to see this through in court and the response we got was:
Many thanks for your e-mail.
The short answer to your question is that I will have to takeinstructions – this is clearly a significant development and Thomas Cook, alongwith consumers, other airlines etc… will be pouring over the full Judgment whenit is available to see what the full detail of the Judgment is.
Fingers crossed that "pouring over the full judgement" doesn't mean "trying to find another excuse not to pay you the compensation you are owed"!!!

Hi, this is my first post so I hope I am doing it right!
My son & his friend have just come back from Rhodes where their flight was delayed by 4hrs 20mins. They were told of the delay whilst still in the resort. They were kicked out of their room at noon and told that for E20's each they could have the room until 6pm. They had no money left by then so couldn't pay. They were offered nothing by the way of food or drink and like I said they were skint by that time.
They were not told the reason for the delay but I have learned that the plane was 5 hours late going there so their delay was a knock on from that.
I am pretty sure they can claim the statutory compensation for the delay, but can they claim anything for the lack of help in resort, seeing as they are legally entitled to that help.
Also they were delayed going out by 2hrs55mins again with non of their rights offered to them.0 -

They can claim for the delay over three hours, and any receipted expenses for meals and reasonable soft drinks. Detail is in the FAQs.0
