Flight delay and cancellation compensation, Thomas Cook ONLY

Hi. Just wondered if anyone can help us please?...
We have just come back from Tunisia through TCook, and we are wanting to complain/claim for our delay on the 1st June of this year, regarding flight tcx5208 from east Midlands to enfidha.
We lost a days holiday, nearly a 12 hour delay, and 12pound each for food which ended up covering breakfast.....just. We were told, after our luggage was taken at 2am that their would be a delay, and the vouchers would cover our food. Apparently they knew the day before the flight it would be delayed due to staff shortages. Anyway, after coping with our 5 year old son in a very busy airport, we eventually got away at 3pm, and arrived at our complex around 8pm....on no sleep, and feeling dirty and hungry/thirsty.
Did anyone else experience this magical day/journey???
If anyone could help, my partner and I would very grateful.
Ps....newbie post. Apologies if not making sense. Thanks.0 -
Response to claim made re flight delay in 2011 is asking me to send in boarding card, invoice or flight tickets which I obviously don't have - are they just stalling - surely they should have a log of the names of the passengers who travelled??0

Have a read of the Thomas Cook thread. (plenty posts if you search on "boarding pass") You may have to go down the SAR route if they dispute you were on the flight0

It's a self-help forum. 99% (at least) of questions are answered there.
If you don't fancy doing quite a bit of reading and research, contact a no win no fee firm.0 -
In March 2014 I made a claim of 400 euros each, for myself and my three companions against Thomas Cook in relation to a 8 hour flight delay last year, they have not paid any compensation. I emailed the CAA who upheld my claim they forwarded their findings to Thomas Cook , still no compensation. I recently emailed Harriett Green CEO of Thomas Cook she arranged for a customer service team representative to reply, still no compensation.
Part of their last last relpy which I feel is intimidating is below:-
"We would now recommend that you consider whether you wish to take a more formal approach to your claim and appoint a legal representative. If you choose to do this then we will wait to hear from them."
As the CAA up held my claim do I have a good case?
I am considering taking Thomas Cook to the small claims court has anyone done this and won?0 -
Try reading and posting (if necessary) on the Thomas Cook thread. The FAQs on the first page will give information on the court process0

Hi,
I was wondering if anyone has successfully claimed for an infant from Thomas Cook? I've had a payout for £325 per adult because of a delay, but they tell me the £29 I paid for the infant was an admin charge only and he didn't have a seat, therefore no compensation applies. I have quoted them extracts regarding infants earlier in this thread, but even that reads to me that reduced fares are not eligible (clearly I'm misreading because everywhere says he is!). My ticket breakdown reads "1 x Infant Flight £29"...
Also, our flight was cancelled, we were then re routed to another airport, and after a 7 hour coach transfer finally reached our destination 10 hours late. Thomas cook offered no vouchers for welfare and have ignored the receipts I sent them (with no comment). By cashing the cheque they have sent me for £1300, am I accepting their offer and therefore removing any further entitlement to claim?0 -

The law says: "This Regulation shall not apply to passengers travelling free of charge or at a reduced fare not available directly or indirectly to the public. However, it shall apply to passengers having tickets issued under a frequent flyer programme or other commercial programme by an air carrier or tour operator. Read Article 9 of the RegulationKim.wigley wrote: »By cashing the cheque they have sent me for £1300, am I accepting their offer and therefore removing any further entitlement to claim?
It depends what terms they stated in sending it. If there were no such terms, you can continue to claim up to whatever the Regulation prescribes. I suspect it would be difficult for them to prevent you claiming further even if the letter said the £1,300 was 'in full and final settlement' (or whatever), as it wasn't with your explicit agreement but I am not sure.0 -

So, to clarify this, because an infant fare is available to the public, the fact it's reduced is irrelevant?
(I'm really sorry, I'm not usually so dense, but legal-speak has me going around in circles!!)
I appreciate the time you've taken to respond - thank you. Thomas cook have mentioned nowhere that it was in full and final settlement. Their customer service team informed me over the phone that this was a "pre-emptive settlement" because I believe there was 4 flights affected by massive delays on the same day.0
