So you have already been to court, TC applied for a stay, presumably granted, then Judge threw out TC's defence anyway, and TC didn't respond?
Personally I wouldn't be giving these cut n paste jokers a single second more of my time.
    Just my two penneth worth

But if TC get the stay granted now in the next court hearing which is to determine whether they get the stay or not would I have to pay any costs?

Also, what do people think about the fact that they emailed me, when the whole thing is in my husbands name and not mine? Is this a breach of data protection or are we just wasting our time on a technicality here? I work at a university and have to be SO careful with data protection - I'm surprised a "legal professional" was so sloppy!

Suz from what you are saying, TC will FIRST have to get the setaside approved by the Court/Judge, before they can go any further ie get the default judgement overturned. They must have good reason for not having complied with court direction.
Legal magpie or socrates may be better able to reply.

All these applications will have a fee presumably? And if TC win the Claimant will have to pay these costs?

Does anyone know what sort of money we are talking here?

Whilst I don't actually know, I can't imagine the Court passing on fees for setaside to the claimant, when it's the defendant that has messed up by not complying with a Court order

I had a flight delay in May 2009 by 24 hours where we were put in a hotel before we even got to the airport. I have spoken to Thomas Cook and I was told verbally that we were entitled to the compensation. I then received an email sayingDear Miss Mee

I am writing in response to your recent email.

Firstly let me sincerely apologise for the confusion over your claim.

It was myself who recently issued the email which states that a payment is not applicable for your flight.

At the time I was unaware that you had been misinformed by the previous agent, also named Daniel.

I can only imagine how frustrating and disappointing it must be to be given such conflicting information.

I have informed the relevant department of this mistake in the hope that it will not happen again.

Unfortunately the information I supplied recently is correct and no compensation will be awarded to the passengers of your flight.

    Once again my apologies.

    Kind Regards,

    Daniel McLaughlin

I have tried everything to get help with delayed flight compensation. Nothing on flight stat. Read all relevant posts, and to no avail.

Is there anyone out there, that was on T.C flight, depart Glasgow intl 10/11/2012 at 9.15, arrived Antalya, Turkey, about 5am? Flight was over 6 hours late. I cant seem to find anything, but im very new to this forum. T.C offered me a £200.00 voucher. There were 4 people in our party, holiday cost £2500. Why would they offer me vouchers? All help with this would be gratefully received. Thank you for your patience.

cupful - read FAQ's then decide whether to DIY court case yourself or maybe try a NWNF.
