Flight delay and cancellation compensation, Thomas Cook ONLY

Thanks for you responses a few pages back. I've spoken to a NWNF company and they require a copy of my flight confirmation or boarding card from 2010. Unfortunately I don't have either, but I did write to Thomas Cook on my return over being given the wrong room type which has my booking number etc on it. Any suggestions on how I go about getting the information from Thomas Cook under the freedom of information act? And more specifically exactly what I ask for, as I've heard they can be very awkward.
Thanks again.0 -

I've got an on going claim with Thomas Cook regarding a delay to Cuba. They admitted I had a claim in their first response, but offered me a voucher for €400 per passenger. I have refused the voucher and asked for cash as entitled too. I have been claiming €600 per passenger, but they advise the distance is 7113km and article 7 paragraph 1b applies.
What I fail to see is, why is it only €400 and not €600 I am entitled to as the flight is easily over 3500km as referred to in paragraph 1b. Does my flight come under an "intra-Community flight"?
Sounds like they are confused
compensation should be €600 if delayed over 4 hours and €300 if over 3 hours but less than 40 -

I suggest that you start with the Informatoin Commissioner's website as (presumably) that will tell you what you are entitled to.0 -

To be honest I can't actually remember the time we arrived in Cuba. I know we certainly did not make up over 2 hours and it was scheduled for a 9 hour flight, with an arrival in Cuba ~1805GMT.
I have just checked the flight on flightaware.com and we departed at 1526GMT. The last "confirmed" tracking of the aircraft was at 0033GMT by the Miami Centre, so which is well beyond 4 hours delayed and still not arrived!
I knew it was over 4 hours late arriving, but wasn't sure if they are trying to avoid paying the extra €200 by claiming it was an "intra-community flight?0 -
Hi I haven't been on here for a while but just thought i would give a quick update on my case I passed it to a nwnf last September and it seems to be taking forever the last time it was updated ( any news is updated on my claim which I can check online ) basically they have sent the directions questionnaire into the court and are waiting for a date etc but it's been like this since November u know the process is or quick but that's 5 month so frustrating tc have not asked for a stay so don't understand why it's taking this long.0

I am in the same boat, phoned the court last week and they told me they will get the judge to look at it and send directions to me. I would presume that they are holding them up pending Huzar without requests for stay. So I think it really is a case for relying on this outcome for the airlines.
There is no reason it should take this long, but hey not long now.Check out Vaubans Flight Delay Guide, you will be glad you did....:):)

Hi
We were delayed last year for 27 hours at Sanford airport florida with thomas cook
Some passengers boarded then got off after a couple of hours
We were told by the captain that it had a hydrolic fault and they were trying to fix it
After a couple of hours the captain came again and told us if the plane was not fixed in the next hour his flight hours were over and he could not fly
The plane was not fixed in the next hour so he was out of hours and we were delayed a total of 27 hours
We wrote to thomas cook and they say it was exceptional circumstances and are not replying to us anymore
