  • Hi, hoping some one can help please.

    We were scheduled to depart Dalaman airport (Turkey) GMTtime 23.15 14th June 2012 actual departure was after GMT21.00 15th June 2012. Thomas cook informed us this was due to a technical fault we arrived at our destination well over 20 hours late.

    I contacted Thomas Cook earlier this month and was fobbed off. So asked why and said I didn't find this acceptable and today have had this reply.....

    On receipt of your initial claim a full investigation was carried out by the airline into the circumstances surrounding this delay. This investigation included analysis of historical maintenance data, discussions with engineers, and a review of the activity of our other aircraft at the time. Following this thorough process we remain confident that the technical fault was extraordinary and that we took all reasonable measures possible to avoid the delay in question.

    I appreciate you remain unhappy with this decision, and whilst I regret this, we do not believe that a payment under the rules of the scheme is relevant in this particular case. Should you remain unhappy I can only suggest that you contact the Civil Aviation Authority (CAA) online or call the CAA for advice on 020 7453 6888.

    Am I right to be seeking compensation? Is this worth pursuing?

    hi we was on flight tcx 2868 from manchester to dalaman on the 14 june 2012 at 18.55 but because of tech issues we were delayed 19 hours they put us up in hotel in manchester and got a flight next morning so by the looks of it we was delayed which caused you to be delayed on the return journey

    Success, we have been offered the full compensation value of £2522 by bacs payment, this will be into our acc in ten working days. Start to finish with claim 3 weeks!! :rotfl::rotfl::rotfl::j:j

  • I sent TC Flight Provider's Reference and booking confirmation and got this email back from them today.

    Thank you for your recent email.

    However the documentation you have submitted is not regarded as proof of travel and I must once again request the aforementioned documents.

    What else do I have to send them to prove I was on the flight.

    I was just looking for a little advice. I sent in a claim to thomas cook for a flight in june 2007 but they are saying they cant pursue as longer than 6 years, is this correct or if not what would I say to them, this was their response:

    Your reply email although it does not hold your booking reference has confirmed that your date of your delay was in fact 2007 therefore I am able to reply as follows:

    Initially, I would like to apologise for the disruption to your flight plans. Please be assured that a lot of work goes on behind the scenes to ensure that any delays are kept to an absolute minimum, as we do fully understand the inconvenience and frustration these can cause.

    As you are aware, the European Court of Justice confirmed in October 2012 that passengers could now claim for flight delays in line with Regulation 261/2004, and that this would apply to retrospective delays. The legal rules around historical claims dictate that customers have to submit a claim within 6 years of the date of the delay in question. As the delay to which you refer is outside of this time frame, unfortunately you do not qualify for a payment under the rules of this scheme.

    Please be assured that on-time performance is a key measure for us as a business, and we constantly review our operations to ensure we deliver the best results, and service.     We were delayed from Palma Majorca for 5 hours on route to East Midlands last year. i contacted Thomas cook and complained after looking on this site. They replied yesterday and offered 50 pound voucher to spend with Thomas cook for the 5 of us..
    Last night i replied and told them no thanks and stated,

    We are entitled by law to have the compensation in monetary value so a cheque or bank transfer will suffice.
    secondly
    I stated that on this website the calculator states that over 1500km flight distance then i am entitled to £330 per person. ( our flight was 1507km ) :j
    so, my calculations for a party of 5 we can claim for £1650


    today i received an email...

    stating that they will give me £1344 and to phone Thomas cook to sort out bank details...

    Should i stand firm and ask for the amount that i calculated or just take what they offer.. advice would be greatly appreciated

    What else do I have to send them to prove I was on the flight.

    You don't. Ultimately you will have to take them to Court for them to take any notice of your claim. If they want to prove that you were not on the flight in question when they KNOW you were than that's up to them. You have provided a booking reference and that is enough. Tell them this in an NBA letter and then proceed to Court if they don't pay up. Stop jumping through their hoops!

    You've done well to get them to that stage without starting legal proceedings. I would have thought that they will pay out in full if you ask them too - suggesting that you really don't want to have to make a legal claim but .... Presumably they have given you the "goodwill" nonsense (which "explains" the offer shortfall). There's no goodwill unless they are liable so I would say you must be on safe ground.

    They own you more than that. Phone them and ask why they are not giving you the full amount you are entitled too. They will probably try and say one of the seats was for a child and they won't pay it.
