  • I did read you post David.

I have sent them every document I have I emailed the company I took the holiday with and forwarded the above documents to TC. I sent them all I had when I first went on the holiday, holiday invoice and flight confirmation I don't have anything else to send.

    My post said:

"If you haven't [got documents], there are other ways to demonstrate you were on the flight. It's a regular question on the forum. Just do a search."

If you have done that, you will have the problem sorted.
  • I contacted Thomson today regarding a 15 hour delay from Manchester to Cuba in 2010. They claim I only had 2 months to claim which goes against everything I've heard and read. They said....

Thanks for your prompt response to my colleague Stefan's email.

I can confirm that we are acting on the basis of expert legal advice provided by a pre-eminent aviation law QC, who has advised us that claims relating to delay, whether under EU regulations or otherwise, must be brought within two years according to domestic law. European case law confirms that it is domestic law that should dictate the time limit and we are, therefore, confident that we are adopting the correct legal position.

Thomson Airways operates a fair and thorough process to deal with claims for delay in line with the regulation. The law in this area is complex and many situations will not result in an entitlement to compensation.

I'm sorry if this wasn't the outcome you were hoping for, but please feel free to get back in touch if you've any further questions.

    Kind regards,

Have a search for the Dawson appeal - that will give you the background.

You need to get the arrival time...the flight departed 3 hours 9 minutes late but if it arrived less than 3 hours late then there is no compensation due.
Very often they can make up some time en-route so it would not surprise me if they made up the 10 minutes
  • Thank you for that I didn't realise that the arrival time was important. There is no arrival time on the Stats site, but as you say 9 mins could be easily made up.
