We had a more than 5 hour delay on a flight from Manchester to Antalya in July 2010. I wrote to TC in February 2013, they turned it down in March, I replied, asking for the reasons (& copied in CAA). TC replied to say they had no more to add. I wrote to them again in late March, keeping CAA copied in. I followed up with TC several times, each time including CAA. In October CAA asked TC to reassess their position on extraordinary circumstances. In late October TC eventually replied to my multiple e-mails, again rejecting my claim stating this was "a final response unless the CAA overturn a Thomas Cook Airlines decision."
I was therefore very surprised to receive an e-mail from TC today offering me £339 compensation per person, with a travel voucher to this value. I have asked them to replace this with a cheque.
So the message is to keep trying, the CAA seem to be the ultimate arbiter, and TC will not pay out until forced to.0 -
We submitted the paperwork for the small claims track and trav law have emailed us today to ask us to agree to a stay. They must have only got the information today so have been on to us quickly. Am I correct in believing that we should say no or alternatively say nothing. They say agreeing will prevent both sides incurring extra costs, but to be honest as we have asked for this to be moved to our local court, the costs For us would be minimal.

I had the same back in October. Didn't know the reason for the delay other than they kept saying EC's for 8 months
As such, was Huzzar even applicable.
Just before Xmas they emailed me, to call it a day.

Im ill and I did ask Bott&co to do it, but they've just said they cant due to the latest response. So thomas cook win.
No my flight at the time as we were told, was delayed because it was delayed at the previous airport (MAN) due to a technical nature, and wouldn't be able to fly to us (DLM) till it was fixed. Yes it was around the time of the ash cloud, couple of week after in fact, but my delay had nothing to do with ash, but I cant prove it. No other flights were affected that day, I've checked.0 -

Steve 1500 they are asking for a stay pending the outcome of the appeal in the case of huzar v jet. What would be my argument against agreeing to the case being stayed.

Hello everyone,
I have a ongoing claim with TC and have looked through the posts, wish i had looked here before starting legal action. Any help would be gratefully received.
My flight was on 14/09/2013 and departed from Manchester. Thirty minutes into the flight the captain announced we would be landing into east mids due to smoke coming from a on board oven.
Landed at East mids, was told by captain that the faulty oven would be removed after check by fire crew and we would be on our way minus the faulty oven. This ended up taking time so the flight crew went out of hours.
We had to collect luggage and get a coach transfer back to manchester, we were informed that the plane was being flown back to manchester and we would depart later that night with a new flight crew. We checked manchester airports web site and our flight number had been re scheduled with a depart time of 22:30.
On arrival at manchester we were told that they could not get a full flight crew for an airbus so that the flight would be scheduled for early next morning.
The TC rep told everyone that no hotel accommodation was available due to Man Utd playing at home, this was not the case as we showed the rep a few hotel rooms available online but she insisted operations had said no. So from 10:30 pm until boarding at 07:30 my kids and myself had to sleep on the floor in a closed manchester airport.
I sent a complaint to TC followed by a NBA, same old response about it being EC.
Started a money claim and have received the defence.
Defence states i have failed to set out full and detailed particulars of the claim or a cause of action, and that i made no attempt pre litigation to contact the defendent, I can prove that I did.
They have also stated that i cant claim for others so i may have to alter my claim and pay the fee mentioned in previous posts.
I have today received a copy of the defendants questionnaire and a request to consent the claim being stayed pending the outcome of Huzar.
Any help with regards to what I should do next would be appreciated especially regarding what case i should be referring to if it goes to court.

Hi there I've just joined the site and need some help!! On June 4th 2013 me and my husband were ment to fly with thomas cook from Manchester to cancun but we were 24 hours delayed. We were delayed because of a technical fault on the plane. After the holiday I rang thomas cook to complain and all they offered me was a £50 voucher each, which they didn't send out. Because time has went by I thought it was to late but a friend who works for a different airline said you can claim up to 6 years is this true? Does anyone know if we should get more than the £50 voucher they offered? But my next problem is I've lost all my paper work so I don't know my flight details, is there anywhere I can find this out?:)0
