    I am writing in response to your letter regarding your recent travel arrangements with Thomas Cook.

    Initially, I would like to apologise for the disruption to your flight plans. Please be assured that a lot of work goes on behind the scenes to ensure that any delays are kept to an absolute minimum, as we do fully understand the inconvenience and frustration these can cause.

    It is not always immediately apparent as to when a revised take off time can be secured and a number of factors have to be considered, which quite often rely on outside influences, such as Airport Authorities or Air Traffic Control. We do appreciate the importance of communication, and I would assure you that information is passed onto our customers as quickly as possible, through our handling agents at the airport.

    Having carried out a full investigation the specific circumstances surrounding the delay to your own flight were of a technical nature. These were extraordinary, in that Thomas Cook took all reasonable precautions necessary to avoid the situation, and despite our proactive measures the problem could not have been prevented. All our aircraft are maintained to a very high standard, in line with CAA regulations, however, despite these steps, mechanical failures can arise without prior warning. These unpredictable events can be likened to those we encounter with our own cars, despite having full service histories, or MOT’s.

    In line with Regulation 261/2004 a payment of compensation would not be considered applicable in this case.

    Please be assured that on-time performance is a key measure for us as a business, and we constantly review our operations to ensure we deliver the best results, and service. I would like to offer our apologies for any inconvenience you were caused on this occasion and I hope that despite this, your stay was found to be an enjoyable one.

    No Corkhill: I will not help you. Because this letter has been received - and published on this forum - many, many dozens of times. And it has been discussed extensively.

    Claiming your compensation will not be easy or without effort. And if you cannot be bothered to see if people have answered your question before, I don't think I can be bothered to repeat the same advice.

    Sorry if this comes across as brusque - but there are too many people posting here without reading the other posts first: which just makes the whole forum more difficult to use.

    Find me a single forum where the users are cool with someone posting out of the blue without searching their query first. You can't. It doesn't exist. The posters here are happy to help so long as you are happy to read through.
  • Having initially had my claim submitted to Thomas Cook rejected, reason given plane breakdown "these situations can be compared to the maintenance of your own car" submitted in 2010; on 1st August 2013 I submitted Air Passenger Rights EU Complaint Form to the Greek Authority who forwarded claim to Thomas Cook, I also copied it myself to Thomas Cook customer services, and further copy to the CEO, I have today received a telephone call to say I will receive a refund of £699 (equivalent to Euros: 800). Flight was TXC0908L scheduled to fly at 1800 on 14.09.2010, but did not fly until 00:20 on 15.09.2010. Good luck to anyone else.. just persevere and submit the relevant form.:rotfl:

    Hi

    Just find the Air Passenger Rights EU Complaint Form and submit to the relevant UK authority for the flight out to Mexico, you should get compensation for that, not sure about the flight back as out of EU. If still no joy then advise Thomas Cook you are going through the "small claims court re the judgment of the Court of Justice of the European Union in Tui & others v CAA confirmed the applicability of compensation for delay as set out in the Sturgeon case, as such I am seeking compensation under EG Regulation 261/2004 for this delayed flight". Ask to be advised of the exact nature of the fault as if this was due to manufacturer recalling plane for faulty part to be replaced you may not be able to obtain compensation, but if due to fault re general maintenance you should be, so ask them to specify the exact nature of the faults of the planes that caused the 2 delays. My initial claim for 5 hour delay from Greece to Manchester UK was refused by TC in 2010, on 1st August 2013 I submitted the claim form to the Greek Authority who forwarded claim on to TC, I also copied it to TC and further copy to CEO Harriett Green, and today I have received a call saying they will pay my compensation £699 re 2 seats). You may have to go through small claims court as it is Mexico and out of EU but it will be well worth the effort. Good Luck.

    Hi Everyone

    So after having two emails now from Thomas Cook fobbing me off about my delay , I have decided to take people's advice from here and bypass CAA and have logged my delay with a NWNF company. Bott & Co, When I followed the On Screen steps to log my claim, it put me thru to EUclaim. Im assuming these are part of Bott & Co still? Has anyone used this company? Had much success? I decided to use them as I've seen them mentioned alot on here.

    Been told I shuld hear back between 1-2 weeks, so fingers crossed.

    The majority on this forum are fighting the airlines themselves but if you haven't got the time/patience/tenacity then the use of a NWNF firm is better than walking away. You won't end up with your full entitlement but you will get some money back.
    Yes Bott & Co are linked with EU Claim ~ as few have used not must info re success however this firm seems one of the favourites to use and one of their guys posts on here from time to time. Good luck.
