Honestly the legal fees are minimal - @ £250 in total spent so far - but you pay as you go so it is not all upfront.
Don't let it go - TC rely on just that and that is why you got the initial fob off letter. My best advice - go for it
I aggre with the above. Anyone with a reasonable grasp of english language can study and understand the crap from the airlines, digest the regulation and the various judgements from the EU court (Wallentin,Sturgeon etc).
I did and put such a good case tot he airline it never reached the court and we got all our court fees returned.
My feeling was my time costs nothing theirs is very expensive.0 -
Hi folks, thanks for all the advice I am definitely not letting this go. I have house insurance and I'm sure it covers legal expenses so I will look into this. Would rather try and sort it myself if I can. I will keep you all posted. Thanks again!!

Me and my family were on the above flight. I checked on the Flight Stats website around 6 months ago and it confirmed the flight was delayed 196 minutes so over the 3 hours. I put a claim in and waited. I received no reply and after around 2 months started calling and emailing them with no luck. I then made a comment on there facebook page and low and behold had a email within 10 minutes and the comment had been removed. I explained the situation and waited again for around 2 weeks with no reply. Went through the process again on 2 different occasions before eventually getting an email saying they were investigating. In July of this year they sent an email saying that the flight only had a very short delay and would not be paying compensation. I then checked the flight stats sight and strangely enough the flight number listed above has been used again in July of this year. The original flight from 2 years ago is no longer on there listings. I hoped someone could help me. Is there another way of to find the details for my flight.

Please can someone help, My brother in law was on the same flight that i have just been paid compensation for but he cant find his booking reference and TC say they cant find a record of him but they can of his partner but he needs to make the claim as this booking was made in his name and he is the main leader. Any advise on what he can do would be grateful0

They are clearly lying. TC will go to great lengths it would seem to avoid paying compensation. Send them an NBA informing them it isn't up to you to prove you were on the flight. If they think you weren't it is up to Them to prove it. Then take them to court if they don't pay up. You already know someone who has had compensation for this flight so it's going to cost them a great deal to waste their time.0 -
Having carried out a full investigation the specific circumstances surrounding the delay to your own flight were of a technical nature. These were extraordinary, in that Thomas Cook took all reasonable precautions necessary to avoid the situation, and despite our proactive measures the problem could not have been prevented. All our aircraft are maintained to a very high standard, in line with CAA regulations, however, despite these steps, mechanical failures can arise without prior warning. These unpredictable events can be likened to those we encounter with our own cars, despite having full service histories, or MOT’s.

So I suppose will now have to give them a few weeks more!!

TC have given you their answer. They say you are not entitled to compensation because the plane suffered a technical failure.
What do you think will happen if you give them a few weeks more?

Firstly a letter in March gives the usual "Having carried out a full investigation the specific circumstances surrounding the delay to your own flight were of a technical nature."
Then a second letter dated May 2013 acknowledges that a breakdown occurred, a breakdown which is a private matter etc, etc.
Then for the same booking an email arrives in August with "[FONT="]Having carried out a full investigation, it would appear that the delay on this occasion was as a result of circumstances that were beyond our control."
[/FONT][FONT="]Somewhere along the line there is a hint of misleading information.[/FONT][FONT="] [/FONT][FONT="]MCOL continues its passage.[/FONT][FONT="]
