Thank you for your comment romanby1. I'm thinking the same but also thinking I should try as much as possible to show the judge that I've exhausted every avenue before court. Do you think I'm wasting my time and stamps?
Writing an NBA will be regarded by the court as sufficiently reasonable - especially if the airline refuse to engage with you in any detail.
Otherwise you are just being strung along ...0 -
Back in April I went to tc with a claim , they refused it told me we were not delayed for nearly 5 hours ( I was have proof from flight sats even found on the web plane spotters logs of our plane and times) tc are saying it was only 2 hours so don't have the right for a refund. Tc told us to go to the CAA which we have but have still heard nothing from them. What should we do now? Has anyone ever gone back and tried to re claim from Thomas cook.
CAA are unlikely to help. What flight times do the airline believe applies? And what does the flightstats website say?0 -

All they have said is we were not delayed the times we said, flight sats say we were 252 min delayed our flight was tax 2559 we were due to leave Antalya 18th oct but didn't leave till 02.30 I've even got a screen grab from tc twitter saying they are sorry and we are not leaving till 02.30 local time. Yet still tc are saying no and go to the CAA. When I first spoke to tc about this they said yes it will be sorted but we have two flight logs one with the delay on and one with not??? I think they have gone for the log of one with not.0 -

I've just spoken to Thomas cook again and they are adiment it's only 2.45 that we were delayed. They said we could of made time up in the air. I was on that flight and we didn't land till 04.57 we were due in at 12.45. They said because they have made there decision they cannot go back on it and I have to wait for the CAA ( who are now not taking calls so I've no idea where they are with my case.)
How can TCX have logs saying we were only 2.45 min late? What should I do now it seems like a waiting game.0 -

My story so far, claim started in May 2013 for flight delay compensation for a flight delayed in July 2007.
Given the complete run around for the best part of May and June by TC and they threw every obstacle in my way hoping I would be timed out, so after reading all of the fantastic advice on this forum I decided to take the bull by the horns and start my mcol this was submitted on the 27/06/13, TC acknowledgment 09/07/13 stating that they would defend my case in full. TC legal department contacted me this afternoon 24/07/13 offering me an out of court settlement of over £2000.00 WOOHOO :T
I WOULD LIKE TO SAY A MASSIVE THANK YOU TO ALL OF THE FANTASTIC ADVICE THIS FORUM HAS GIVEN NOT ONLY TO ME BUT TO ALL THE OTHERS STILL FIGHTING

Strange question but turkey has a two time difference have they just forgot about that? That could explain why they are saying its two hours less.0 -
When airlines have a delay do they have to log the reason somewhere, like the CAA for instance, so that ordinary people like myself can find the real reason for the delay? Do we have the right to know under the "Freedom of Information Act?" I've scoured the internet but can find nothing. It would be a huge shortcut for trying to settle claims and would save everybody (Airlines, CAA & public) a huge amount of time resolving valid or invalid claims.0
