    Hi everyone,

    Thanks for all of the great advice given I am just requesting a bit more! My family and I were delayed on 30/08/2010 coming from Reus to Manchester. The delay was 4 hours 15 minutes and as such I have claimed for 250 euros per person. I have sent my NBA and TC have sent back a rejection letter saying bird strikes affected the flight time and an engineer took a while fixing the problem (EC). Now I believe that the flight before ours was delayed meaning ours was delayed which from my reading of all of the FAQs etc is not an exceptional circumstance.
    My question is "Does a bird strike on the previous flight count as an extraordinary circumstance" in anyone's opinion here or should I start an MCOL claim. I think I have them pretty much bang to rights, the flight before was delayed meaning ours was a knock-on and therefore not exceptional but I would love a little advice before slapping an MCOL in.

    I know there are a couple of grey areas, namely bird strikes and knock-ons but what are peoples opinions to the fact that if a bird strike affected the plane on its way to Reus before we got on it to come back to Manchester as TC said then why was thay flight delayed by almost the same time? Surely this is a lie as both flights were delayed and if there was a bird strike on the way over then that flight wouldn't have been delayed. I would appreciate your opinions before I put an MCOL in.

    we had the same excuse, for a bird strike on a previous flight, when we pointed out we checked the FAA site for such a strike, Thommos then changed their excuse for delay. So, do your homework, Bird strikes are supposed to be reported to CAA, in USA its the FAA.
    In hindsite, I shouldve kept this up my sleeve, but you have the means and info to knock dead their EC claim.
    Also, bird strikes are a common occurence ( youd be surprised ). and are they really an extraordinary Circumstance? planes and birds share the same airspace, so it happens.

    I sent my second letter recorded delivery on 15th April . Still no reply ....

    What do you advise my next action should be?

    Write another letter or go ahead with a small claim (court) ?

    If you believe writing another letter will help, then by all means write. And then a third. And a fourth ...

    Has anyone used the ECC form to complain as their delay/cancellation was on the return journey. Ours was from Portugal to Manchester? is it worth it? TC won't disclose the technical nature that caused the delay. Are they likely to know?
    Any advice appreciated.

    Hi there, Excellent site with great information.

    Last week I used the link given at the first page for Thomas Cook Customer Services to email a claim for the delay on our flight TCX473 Sandford to Manchester on 12/10/12. I have not received any confirmation email that it has been received, should I send the template letter by post also.

    The airlines hope you will go away if they do not respond. If you do not get a suitable response it's an NBA letter with a 14-21 day deadline

    Thank you for your comment romanby1. I'm thinking the same but also thinking I should try as much as possible to show the judge that I've exhausted every avenue before court. Do you think I'm wasting my time and stamps?

    Back in April I went to tc with a claim , they refused it told me we were not delayed for nearly 5 hours ( I was have proof from flight sats even found on the web plane spotters logs of our plane and times) tc are saying it was only 2 hours so don't have the right for a refund. Tc told us to go to the CAA which we have but have still heard nothing from them. What should we do now? Has anyone ever gone back and tried to re claim from Thomas cook.
