    Well, actually not *exactly*, being that the CAA are the UK appointed governing body.
    But seeing as how the CAA are actually meant to be 'fining' the airlines for non compliance - the case with Thomson and the 2 year claim is a classic - but sitting on the fence doing nothing makes them next to useless IMO.
  • Good news, after being constantly being told no to a claim i had against Thomas cook back in 2007, i went to one of these websites which take it on for a %.

    They were on the phone yesterday saying thomas cook will not be defending in court and will post out a cheque for just over a thousand pounds, ok ill give up a percentage but a percentage of something is a
    lot better than 100% of nothing!!!!

    What makes it all the sweeter was we served the court papers with a day to spare before the 6 year rule. lol!!!!

    So dont give up and if you are prepared to forgo a % for no hassle i can recommend a company if required.

    Simple as that really. Writing to a foreign AESA will incur a judges remarks of 'they don't have jurisdiction in a UK court' so there's little point unless you know how to advocate with a judge.

    AESA don't have any jurisdiction as you say but- their report will state that they have studied all the evidence and allegations (if any sent by the airline) and they will have made a sound decision based on this as the regulatory body. If the airline has failed to respond to them then this too speaks volumes. In AESA's report they will have said that any decision they have made may need the individual to progress this to court to implement this.
    Their report is a sound base and a good piece of evidence to use in any court claim that any judge would find difficult to ignore.
    Successfully sued Ryanair in 2013/14...and have been 'helping' litigants since then.

  • Hello, I got delayed 24 hrs in Mexico in July 13, I have done the letter to TC and have been sent a voucher for £704 for two people. It was 24 hours and over 7000 km so I was claiming €1200 for both of us.

    Should I write back for the full amount and can I ask for a cheque as the voucher limits me to TC and only lasts 12 months?

    By the way the address I posted to is below just in case anyone needs it.

    They, in making the offer have admitted liability.
    You should stick to your guns and insist on the full amount which is 1200 Euro which is just over £1000 and also a cash deposit in your bank. Don't return the voucher yet.
    You could issue it as a NBA if they do not respond within 14-21 days your choice.

    Once again I have been shafted by TC ......
    During my initial telephone conversation with TC legal on wed 24/07 the woman representing them offered me an out of court settlement on the promise that my cheque would arrive Friday 26/07 as quoted by her "cheques are drawn up on a Wednesday so this will be with you no later than Friday " I don't even know why I believed this I think I was slightly giddy at the fact they had folded, Success I thought and even gushed about it on here.... Friday came and went surprise surprise NO CHEQUE:mad:
    I have since e-mailed and rang but to no avail just got the generated we will investigate this matter further blah blah blah. So I have advised them I am retracting my agreement of settlement and will see them in Court as originally planned.
    I was made aware on 25/07 that TC had until 26/07 to file their defence so that is the only reason they offered me the settlement.

    Browse the forum. There is so much constructive information here. Yes it will take time but all the contributors have taken their time to keep the forum up to date. Start with the EU law itself (available on their own website). Check the articles. Does your flight comply with the criteria to make a claim? If it does, then use the template letter as a starting point. You have to put in the effort and have all your facts straight. You have to have your evidence to support your claim, boarding card/booking references delay information etc.

    Read the law... If they are sending you compensation then you are entitled to the amount under the law and they are ,more or less, admitting liability. A voucher is a cheap way of getting out of paying you. ( they provide a 'service' at 'cost') so you don't get your full entitlement....read article 7.
