  • Massive thanks from me to all on this thread. Letter received today saying tc are settling my claim in full for flight delay in july 2007.
    Just had judgement by default issued yesterday via mcol but looks like it won't be required now. Won't be truly happy until I get the cheque which apparently will be with me soon. I was very unsure about the mcol process but kept going mostly due to the encouragement on this board so once again THANK YOU VERY MUCH GUYS! x

    Just a thought, but I hope that the offer to settle includes any interest you might have included on your claim and any filing fees/court fees you have incurred so far. If it does not, you deserve this for taking it so far and TC deserve to have to pay it for stinging you along to the point you had to issue a court claim for it.

    You have a default judgement so in my view you can insist on these being included....

    My £80 court fees are included in the offer but I did not request interest. However the settlement figure is calculated at the euro/sterling rate as at june this year when I filed mcol and not as someone on here has been offered the euro rate from 2007 iyswim. This gives me roughly £300 more so I consider that to be adequate. It's a pity they made me take it this far .. ..can't be good for business

    How long did it take from initial submission to getting your court date?
    Roughly how much notice are you given?

    I'm also hoping that TC will settle before court.

    Submitted via MCOL mid April - to-ing and fro-ing between court and a refusal of mediation (what is the point as if you have broken the law you pay the price?) - so will be almost 5 months from start to court date - I will start my preparations next week for court.

    I have just received an email from Thomas Cook, they have agreed the full compensation claimed for two passengers a total of £702. They have attached a voucher for the full amount. I am absolutly made up, this means we can have another holiday very soon and I can only commend Thomas Cook for their extremely prompt resolution to this claim. Thanks to everybody who has posted on this forum, I can't believe how quick and easy the process has been in my particular case.

    just arrived home tonight from menorca,after leaving my hotel at 7am on Friday 19th july.
    our flight time was 10.45,we checked in on time,and had our boarding passes(family of 4)
    we were given a letter stating that due to a technicality the plane for our flight was no longer available,their operations dept had sourced an alternative flight which unfortunately had fewer seats,but we were flying at 1130,which wasn't a problem.
    3/4 of the passengers boarded the plane,but when we went to board was told we wasn't on that plane,ours wasn't available at this time,and we should go to Acension to get further details,but 3 hours later,and with the other flight gone,my family was still waiting on a Thomas cook rep coming to speak with us,eventually one arrived,we were told we could go to terra cotta cafe and each person could spend 6 euros with our boarding cards,she further announced that the plane that departed wasn't big enough to take us back to Manchester,and another had been sent for,which finally departed 6 hours later
    I also had to endure my son,who is 14,going into tantrums as he has autism,he was punching walls,shouting verbal abuse in the middle of the airport because he couldn't understand why he wasn't allowed on that plane
    we checked in at 10am roughly,but we never left menorca til 1640,and still had a 4 hour drive home to Scotland to negotiate
    where do we stand in this,are we entitled to compensation,how do I go about getting this and making a complaint,im really !!!!ed off

    Yes you are entitled to compensation and you are (unlike others) on the appropriate thread. If you flew with Thomas Cook start of by looking on page one of this thread at the FAQ's. All the answers are there and I doubt you will need to post again if you read through it all! :)

    Thanks, but you will need to push the solicitor along a bit as they are instructed by the insurance company to do it for as cheap as possible although that doesn't stop you instructing them to get a move on! The original solicitor they appointed me was more than useless. Took weeks to do anything and told me that Thomas Cook doesn't have the money to pay me if I won the case! The claim is only for €800. I sacked her and got the company to appoint me someone else who is pretty good to be honest but still a little slow. Remember, the rules for claiming from your insurance company is that after they review the claim you only need a 51% chance of winning for them to take it on. After that and if they think it's costing them too much they sometimes just pay you the claim themselves to drop it. I hope they don't do that in my case. It's Thomas Cook who need to cough up the bloody liars!

    Well had my mediation yesterday and they have paid up in full inc my fees so a huge thank you to everyone on here for giving me the courage to keep going just waiting for the cheque now :) what a lovely birthday present yeah :)

  • I am starting this thread for those claiming flight delay or cancellation compensation from Thomas Cook.

    Any posts regarding any other airline in this thread will be ignored (at least by me).

    Im new to forun and just created a post to say that i HAVE received compensation but its in voucher form with 1 years validity. As pleased as I am I wonder if I could have had the cash do you know if this is case how to take it forward??
