Sky rat, I have looked back through your initial posts and cant see that you mentioned a reason for your delay. Could you post the exact reason purely for information only - assuming that you were ever given one by TC that is - I am at the stage where I have initiated an MCOL claim a couple of months back and I am awaiting allocation to track, I am interested to know why they offerred settlement before the case made to court. Thanks0

If you have gotten to the stage where your case has been allocated to a court and you have paid an additional 'hearing fee', then you can claim this back from the court when you cancel your hearing.
As long as cancellation is in writing and received by Court at least 7 days prior to the hearing date.0 -
I have filed for court action re my 15 hour delay from Antalya to Gatwick which ended up at Stansted due to cracked cockpit.
The letter to the defendant orders within 7 days must file a statement setting out there reasons for declining mediation and are invited to re consider as regarding to the court of appeals decision in Rolf v De Guerin (2011) EWCA a civ 78 as the winner did not chose mediation there costs will not be recovered .
Has anyone else mediated before arriving to court ?0 -
I'm going to try out letter for our recent Sanford to Manchester flight which was delayed.
I am thinking though of getting a company to do it though, they do take 29% but I'm a bit over-awed with all these legal matters and it certainly ain't my forte.
I can try an initial letter still and see the response if it's scary looking can opt for this.
It's a no fee basis, unless I win.

Hi
Just looking for advice before contacting the CAA after Thomas Cook have refused compensation. We were on flight TCX3648 from Glasgow to Sharm el Shiek on Mon 24 Sep 2012. Our flight was delayed due to being used as a delivery vehicle to drop off spare parts for another aircraft that was in Cyprus. We were 2 hrs and 14 mins late in initially taking off and after the diversion to Cyprus were over 5 hours late in arriving at Sharm. Are we due compensation??0
