    It's not a scam - flightmole has been around for quite some time. I suspect that they are very busy. If they've taken your case on, I would leave them to it for a bit. You can always go on their forum?

    [Edit] Though I see the forum and the claims service are off line at the moment. Odd.

    That's cool, I assumed they were busy but find not replying back for 4+ weeks little worrying. Either way you're probably right and yes I checked the forum before I wrote here so as you say, off line. Cheers anyways!

    Passengers, many with young babies, were begging for hotel accommodation as delay was carrying over into next day but TC blanked us.

    Usual excuses from TC quoting EC's but they omitted to mention the initial 5.5 hour delay in their defence statement. They also used the Montreal Convention 2 year time bar but I'm not buying their guff.

    I wrote to the Spannish Air Authority (AESA) to investigate who have confirmed in writing that they have investigated and found no evidence of EC's and that they have written to TC advising them to pay out. I attended Scottish Sheriff Court Preliminary Hearing last week with Proof Hearing set for early September.

    Any help appreciated.

Don't know why you had to do this, in Scotland the court serves the summons to the airline they get about 6 weeks to defend and then it goes to a hearing in all it takes about 2 months start to finish.

    Ecs should not normally be regarded as ECs, but airlines are quite happy to, and have won a few cases on the back of it. EC 261/ 2004 was introduced among other things to stamp out long delays and cancellations, when you think about it the main reason for delays is down to technical problems.! Have a look at post #2314, use that along with wallentin, and Sturgeon, should be difficult to argue against

    Thanks for your interest but to clarify things, the Sheriff Court did serve the small claims summons on TC 6/7 weeks ago and last week we had the Preliminary Hearing which TC defended. The Sheriff has set the Proof Hearing date for early September.

    I got an email with voucher on 3rd June ,I requested a cheque same day via email, I received my cheque on the 13th June .I still have voucher! not that I will use it,but they did not ask for it back first.

    My cheque finally arrived today for £2,080. For anyone else who may be searching for the same flight the details are East Midlands to Mahon on Friday 8th June 2012. Flight was delayed 3hrs 30mins. Flight Number TCX5158

    Hi all
    I wrote to TC in April using the template letter claiming compensation at €600 each for three of us for a five hour delay on a flight to Egypt in March.
    I heard nothing for two months then received a voucher for £700, after two calls they said they had made a mistake and would send the balance, for which I am still waiting.
    They said that i would have to make a separate claim for the third passenger in their own name, which I did. Yesterday I received an emailed voucher for £50 in the third passenger's name.
    They have obviously admitted we have a case by sending the vouchers but for the wrong amount, but where do I go from here? Advise gratefully received.

    Last year I was delayed with my family for over 23 hours when our plane never arrived due to a technical fault and never got off the ground in Manchester, I sent a letter to Thomas cook seeking compensation and I got a rejection letter saying that because we were put up in a hotel our welfare was adequately looked after which I can assure you it wasn't as we were treated like cattle and at 1 point I got separated from my family due to the lack of organization and many other incidents I could mention,has any one else gone through this situation and able to give any advice thankyou.i immediately emailed them back to say I was un happy and give them more details about how we were treated and that I was going to write to the CAA not had a reply,do you think they will or will they just hope I will go away and should I phone them ?
