    TC response today following my NBA -
    Thank you for your most recent correspondence, I am sorry that you feel I have not answered your questions fully.

    I have given you all the information that I have available to me, You are within your rights to seek clarification from a 3rd party if you would like to pursue this matter further, as I am unable to give you any further information.

    I appreciate that your view of my findings may not change as a result of this response however, I would like to thank you for taking the time to contact us.


    What a useless, standard response. They are clearly not even aware I HAVE involved a third party i.e AESA!

    Well no surprise there, we all know how the CAA is funded. Wallentin certainly doesn't support the CAAs ditherings, but without knowing the official cause you are betwix the rock and a hard place. I wouldn't drop it, you could always go down the NWNF route.

    Spot on Evansabove quite sure no one actually reads out letters / emails, or certainly no one with more than two joined up brain cells. They appear to be following some kind of template, which everything has to fit into, if it doesn't they just make it.They just try to spin it out until you get bored, die, or they go bust, just stick to your strategy.
  • I know lots of of people have had vouchers and have requested cheques (me being one of them) how long have you had to wait. I have gone past the 28 days that they quote. phoned them and they said it would be received by the end of the week.. A week later nothing.. I phoned again today and was told It would be investigated and I would get an e-mail but I'm not holding my breath

    What have your experiences been with getting vouchers transferred to cheque?

    Took them 14 days to pay me after I returned their vouchers.

    Hi Everyone

    Does anyone have any more detail than what's already on the Thomson thread about the case where Tommy's daughter won damages against Thomson Airlines at Truro County Court. Even the ladies surname would help. I've tried to find media references to it to use on my day in court against Thomas Cook following a 16.5 hour delay from Palma to Glasgow on 12 October 2010.

    We had an initial delay of 5.5 hours due to TC's excuse of "adverse weather" (must have been somewhere else in Europe as it was wet but unremarkable in Palma) and other flights were flying in and out, then a failed taxi attempt due to mechanical failure resulted in a further 11 hour delay whilst engineer and parts were flown out from the UK.

    Passengers, many with young babies, were begging for hotel accommodation as delay was carrying over into next day but TC blanked us.

    Usual excuses from TC quoting EC's but they omitted to mention the initial 5.5 hour delay in their defence statement. They also used the Montreal Convention 2 year time bar but I'm not buying their guff.

    I wrote to the Spannish Air Authority (AESA) to investigate who have confirmed in writing that they have investigated and found no evidence of EC's and that they have written to TC advising them to pay out. I attended Scottish Sheriff Court Preliminary Hearing last week with Proof Hearing set for early September.

    Any help appreciated.

    Story so far:

    08/03/13 - Sent initial letter claiming compensation
    11/03/13 - Recorded Delivery confirmation
    31/03/13 - TC requested delay information from airline
    08/06/13 - After several phone calls to TC and confirmation that they'd not received a response from the airline, LBA sent to TC
    15/06/13 - Email from TC to say they're investigating and thanking me for my patience
    16/06/13 - Responded to say that their lack of contact is unacceptable, they have had time to investigate and if I don't receive a response within the 28 days I will commence court action.

    Have I done the right thing? I think I've been pretty patient with them as it's now more than 3 months since I first wrote to them and I have had to keep phoning them to find out what's been happening (or not, as seems to be the case).

    Feedback welcome and appreciated.

    To be honest, I think you've probably been too patient. You've previously given them a deadline to respond in your Notice Before Action, so giving them further deadlines is not necessary (and risks suggesting to them you're not serious about taking it further).

    Hi all,

    Just thought I'd share my experience so far and hopefully get more advice.

    I sent my initial letter 26th April '13, didn't get a response so phone TC last week and spoke with complaints dept. We were on flight TCX 2193, 21st August 2012 from Kefalonia to Manchester. We were delayed till the following morning, (me and my OH traveling, delayed overnight, claiming 400 Euro each)

    I emailed Harriet Green CEO of TC yesterday as I hadn't had a reply to my initial letter. I got a call from Jon Brandick in her office yesterday afternoon.

    He told me that they had looked into my claim and the flight was delyaed due to a technical nature and could not give compensation. He e-mailed the usual...whilst delays are an unfortunate part of air travel..blah blah...this can be compared to any mechanical breakdown..blah blah..same stuff everyone seems to get!

    I have read through most of this forum and I yesterday found post number #1436. It appears that this poster was on our flight and received compensation with no issue at all. ( I am going to PM him to find out what he did)!

    So a few questions. I guess now the next stage is to send a NBA to TC, contact the CAA with complaint letter and be prepared for a court case?

    Was anyone else on this flight?




    Hi Fuerty,

    Yeah, I sent TC an LBA just before I went on holiday. I received an e-mail back from Jon in Customer relations. He said that the delay was " unforeseen due to a technical fault relating to the Spoiler Hydraulic where no previous leakage prior to this event was found"

    So after arriving back from holiday today, I'm going to begin legal proceedings tomorrow.

    Quick questions for anyone else out there, do you think the above technical issue holds any water? Is it a valid excuse not to pay me compensation? I'm taking them to court anyway, just after some opinions.

    Best of luck with your attempt through the courts. I seem to recall the reason given at the time was due to an hydraulics problem. Keep me informed on progress.
