    Sent a letter to Thomas Cook on the 1st May for a delayed flight i had last year and on the 12th June recived a Voucher for £702.00 The flight number is TCX2157 LARNACA TO MANCHESTER ON THE 25/28/2012 Departure time was 11-40pm A big thank you to Martin and his team :beer:

  • Submitted a claim after a 15 hour delay in Tunis Airport flying back to Manchester; no problem with acceptance of claim BUT it was offered as vouchers for future holidays. Am I wrong in thinking that I can demand a cash payment. Also the compensation was paid individually to my wife, myself and my 17 year old son. The last thing I need is for him to let loose with £300+ -can I demand that compensation is paid to the bill payer, or an adult, or have I got to bite the bullet?

    Just thought I'd share my experience so far and hopefully get more advice.

    I sent my initial letter 26th April '13, didn't get a response so phone TC last week and spoke with complaints dept. We were on flight TCX 2193, 21st August 2012 from Kefalonia to Manchester. We were delayed till the following morning, (me and my OH traveling, delayed overnight, claiming 400 Euro each)

    I emailed Harriet Green CEO of TC yesterday as I hadn't had a reply to my initial letter. I got a call from Jon Brandick in her office yesterday afternoon.

    He told me that they had looked into my claim and the flight was delyaed due to a technical nature and could not give compensation. He e-mailed the usual...whilst delays are an unfortunate part of air travel..blah blah...this can be compared to any mechanical breakdown..blah blah..same stuff everyone seems to get!

    I have read through most of this forum and I yesterday found post number #1436. It appears that this poster was on our flight and received compensation with no issue at all. ( I am going to PM him to find out what he did)!

    So a few questions. I guess now the next stage is to send a NBA to TC, contact the CAA with complaint letter and be prepared for a court case?

    Was anyone else on this flight?

    Yeah, I sent TC an LBA just before I went on holiday. I received an e-mail back from Jon in Customer relations. He said that the delay was " unforeseen due to a technical fault relating to the Spoiler Hydraulic where no previous leakage prior to this event was found"

    So after arriving back from holiday today, I'm going to begin legal proceedings tomorrow.

    Quick questions for anyone else out there, do you think the above technical issue holds any water? Is it a valid excuse not to pay me compensation? I'm taking them to court anyway, just after some opinions.

    Technical issues are not normally regarded as ECs, read the last three paragraphs in Sturgeon Case (link in FAQs)

    Find out from flightstats if any other flights from PMI to the UK which would have similar routings were subject to the same or similar delays which might lend credence to teh industrial action excuse.

    Thanks - I have done an extensive search on Flightstats for all incoming/outgoing flights from Palma airport on that night and alwso the following morning - As I suspected, mine was the only one with a 6 1/2 hour delay - Easyjet, Monarch and Thompson all had flights departing at roughly the same timeframe as mine and they all left roughly on time.

    Also I checked MANCHESTER arrivals on those dates - could not find anything specific as to long delays there either.

    I feel my next step is to go through MCOL as TC will not give me any proof of industrial action even though I have requested it twice.

  • Have used the money saving expert template for delayed flight compensation and would like to report was successful in that Thomas Cook agreed to the compensation. However we have been sent a Thomas Cook holiday voucher for the amount to cover 4 adult flights to Florida! Am I entitled to receive this compensation in in a personal cheque or do we have to accept their voucher and then I will have to compensate the other people involved!

    Send back - keep copies - demand a cheque or BACS - you are entitled.
