  • Today I received a voucher for £1,388.00 as compensation for our holiday flight delay back in 2011 from Mahon to Newcastle upon Tyne. I thought that they were supposed to send a cheque for compensation, and not a daft restricted voucher.

    Also the voucher is only valid for departures up to and including May 18th 2014, this voucher is of no use to me as it is doubtful that I would be able to use the voucher by then. I am already booked up and paid for on a holiday with First Choice, for this year and doubtful whether I would be in a position to take a holiday on health and age grounds next year, also we don't want to use Thomas Cook again, what is my position? And how should I deal with this?

    Under article 7, para 3, compensation must be paid in cash, cheque, etc., and only with the signed agreement of the passenger can holiday vouchers be supplied. Write and tell them this, giving them 14 day to comply with the law, or you are going to take them to court. Under no circumstances part with the vouchers until you receive a cheque

    Have you written to them yet, asking for compensation under EU 261/2004 , |If it looks a straight forward case I would certainly chase it myself. If you read Centipide 100s FAQs at start of thread you will see it is not a walk in the park. I started chasing TC last June, and the case goes to court next month. On the plus side TC appear to be settling more cases earlier, and folding before cases get to court.
  • today I received an offer of compensation via email for my claim for delay on flight mT149 from Cancun in April.

    The offer was £1044.00 in thomas cook vouchers. I have replied and asked for a cheque to this amount. Total time to get to this stage so far: 1 month.

I note that you say (Under article 7 Paragraph 3 compensation must be given in cash etc.) I cant seem to find this where is the publication that this is from and could I ask if you would be kind enough to supply a link to this.

    Is the £1400 insufficiently motivating either to use google or to look at the FAQs on page one of this thread that has the link?

    I'll give you the link for 30% of your claim.;)

    I've just came off the phone to Thomas Cook said the flight was only delayed 2hours 52 minutes. They have it on a spreadsheet which they have said is correct.

    I engaged a solicitor via my home inusrance who advised the same as previous posters on here;

    1) "private citizens are barred from bringing a claim solely under the denied boarding regulations".

    2) "Following this ruling, there have been a number of cases which have been struck out of the Court. It is likely that any court proceedings taken in this matter would be struck out".

    Is there any point in me taking this further? Its taken from November to get this far, I know it was up to Thomas Cook to prove that it wasn't over the 3 hours, but to say it over the phone to me, they must have something, whereas I have nothing at all?

    If you read the posts on this site you will see your insurance solicitor is wrong.
    The insurance company are just not interested.
    Tell the airline to provide documentary proof of the time of the delay(that is how much later you actually landed than you should have done). Any one can say they have a spreadsheet.
    If you were on the plane and it was more than 3 hours you can sign a statement to that fact. They must prove you wrong not the other way round.
