    We had a 7.5 hour delay which the TC airport staff told us was due to the incoming flight having suffered a blocked toilet. Initially they said it would be 3 hours so were sent packing into departures, where 30 minutes later they announced a further 4 hour delay! We had 10 euros each for refreshments for the whole period. I have claimed compensation under the EU ruling. TC have said no compensation as it was due to 'extraordinary circumstances' which were 'unforseen'.

    I have responded in usual fashion using the suggested templates stating it is poor maintenance and is a common problem so can't be unforeseen. I asked them to confirm the reason for them claiming 'extraordinary circumstances'. I didn't hear anything so sent a claim to the Spanish CAA 6 weeks ago. TC have now responded "we are unable to detail the cause of the breakdown as this is a private matter to be addressed by Thomas Cook". Astonishing. Hence, they are still claiming 'extraordinary circumstances'.

    I have 2 questions 1)is a delay to your flight cuased by a blocked toilet on the incoming flight an 'extraordinary circumstance' as Watchdog advised a few weeks ago that 'extraordinary circumstance' is only a defence to the subject flight; and 2) can they refuse to confirm the reason for the delay?

    Grateful for any advice - new to this so apologies if I've missed a previous similar thread.
    They are having a laugh! Read Sturgeon final paragraph (3) of ruling, toilets are very much a part of "the normal exercise and activity of the aircarrier" , or they wouldn't provide them. Seven and a half hours to fix a blocked loo? plus could the flight not have operated with one less loo (don't know if there are regs about this mind)

    Tell the airline to provide documentary proof of the time of the delay(that is how much later you actually landed than you should have done). Any one can say they have a spreadsheet.
    If you were on the plane and it was more than 3 hours you can sign a statement to that fact. They must prove you wrong not the other way round.
    First it was Thomsons 2 year nonsense now this rubbish. Wonder if these solicitors have a clue?

    Your solicitor needs to check their facts as they are wrong, wrong wrong!

    Out of interest, what company of solicitors is it you are using?
    I only ask so I never end up using them if they can get something so simple, so wrong considering they probably charge a minimum of about £150.00p/h!

    myself and 7 family and friends were delayed at Manchester airport on the 1 July 2010 going to Dalaman. The flight number was TCX506 L and it was due to leave about 10.30 am and we did not leave until about 10pm. They kept providing us with refreshment vouchers throughout the day however they never really said what was delaying it other than technical problems. Passengers were getting really irrate at the lack of information given and crowds kept gathering but very little was still said.

    Was anyone else on this flight, and have they claimed ?

    will the fact that I havent got a booking ref number (i have trawled through emails but i must have deleted it) hinder my claim. I have tried to find this flight on skyscanner to no avail. I do not have the booking form but i do have my bank statement paying for the holiday to Thomas cook online.

    I have produced a letter and i will send, should I include a copy of my bank statement , now (blanked of course) would this help.

  • Recieved a email last night (01:08) to apologise for the disruption to our flight plans and after having carried out a full investigation an offer of compensation of £348 x 2 (£696).
    They "took the liberty of enclosing a discount voucher to this value"
    Have emailed back to advise cash or cheque
    Very quick action as we only contacted them yesterday afternoon by telephone

    Sorry my flight number was TCX 248K , (the other was the return number). It was due to leave manchester for Dalaman at 13.55 but actually left about 10.30 pm, Ive checked on flight stats and it says no status.

    Sorry for my third post in such a short time but I have been reading through some threads which have evoked some questions.

    As I was the lead passanger and paid for the total holiday out of my bank account will they require authorisation for the other 7.

    As i have said, I cannot find a booking ref / email ect but do have my bank statement, I read somewhere that you can request for them to check you travelled, is this correct (cant find where I saw it)

    Beyond that, how was your holiday? Any issues on the flight back? (we stayed behind).

    And a general question to everyone. How do you get to see delays in flightstats for past dates? I go to the delays page, put in origin and destination but I can only select current and future dates. I don't need it at the moment but it irks me I can't work it out.

    You have to register with flightstats.co.uk to view past flight logs.
