    A quick google on "cracked windscreen flight compensation" will get you the news report of the case (Sorry, MSE won't let me post a clickable link). It seems he got judgement.

    It did, thank you. It seems he obtained judgement as the defendents failed to appear. If I've understood the way case law works correctly by failing to defend their case they conceded that their previous arguments were invalid.

    Well I'm pretty sure that Monarch's failure to provide the evidence required - and their subsequent refusal to turn up - tells you all you need to know about the strength of their arguments.

    But remember that as this was a county court hearing it set no precedent - even if the judge had ruled specifically on the cracked windscreen issue.

    Anyway this is academic, as it looks like you'll be paid out. You can thank Mr. Huzar, rather than Dr. Longden, for that!

    I'm knew to this forum but have been reading some of the posts and it seems I'm not alone in my quest for compensation from monarch airlines.
    i submitted a claim for compensation in july last year for a flight delay of 5 hours from dalaman to luton. i went through there correct procedure to be given letter after letter to say they are looking into the claim. i was give three different reasons for the delay but no specifics.
    after nearly a year monarch refused the claim stating there was difficulties with the tyre. on landing the tyre had got a puncture through some debris on the runway.However the previous reasons had been, firstly, technical fault then foreign object debris then when the claim had been refused it became a safety issue.
    if the reason had stayed the same and monarch had been upfront from the beginning i would have accepted that reason but know i feel I'm being fobbed off and i was wondering if anyone else had been given a similar reason. after reading about the new ruling this september i will be resubmitting my claim again. it seems that monarch are only paying out on the claims which people are prepared to take to court.:mad:

  • Monarch Flight Number ZB565 Tenerife South to Manchester 20th September 2013.

    I originally sent my flight compensation claim by the end of September 2013 asking for 800 euros for the 5 and a half hour delay, it was rejected on the grounds of extraordinary circumstances, i decided not to take matters further.

    Just over two weeks ago I saw on the Money Saving Expert weekly email that people were having some luck in getting compensation so I thought I would try again, I resubmitted all the paperwork and today i received a cheque for £292....not as much as I had hoped for but considering the first claim was rejected some two years ago i am delighted with the outcome. If you have been rejected in the past I would definitely try again! :)

    vicksmiler - if you think you were entitled to €800 (presume €400 x 2) it would appear you have only received the £ conversion for one passenger.
  • 111KAB I calculated it using the distance travelled and also the time delayed for which is how i got to 800 euros. There was no correspondence to explain just a cheque and remittance advice.....do you think I should contact them or be happy with what I have received?
