Ive put in a claim for Mon1828 18/7/2011 (which is on the list for already paid out) and Mon1829 1/8/2011 delayed 7 hours for both god love em!!!
Ill update any news if anyone was on those flights and interested.
Im trying to avoid the claims companies if i can help as 26% plus fees is astronomical and the form filling wasnt too hard!!0 -

Unfortunately the form filling is the easy part .... extracting money out of Monarch is a different story!0 -
omg - this doesnt happen to me.
i have just had 2 emails from monarch ( obviously claims were seperate per flight).
They have agreed to pay up for both flights for all 4 passengers - bizarre seeing that i only posted about it today. Though i did send the claim in 3 weeks ago.

They've previously declined compensation claiming the cracked windscreen which caused the delay was an 'exceptional circumstance'. There are two relevant court cases here - the first last year which established that cracked windscreens are not automatically exceptional circumstances and the second recent one clarifying the nature of exceptional circumstances. Apparently they are sending a cheque within 29 days.0

What case is this, regarding cracked windscreens? I'm not aware of it.
A cracked windscreen COULD be extraordinary, if depends on what caused it. Sabotage or a hidden manufacturing defect (affecting all windscreens of a similar type, and reported to the CAA) would make it extraordinary. But almost every other normal cause wouldn't.
I won my court case last year against Monarch, which was about a cracked windscreen.0 -
Sorry to pop in the discussion - long time lurker!
I am taking Monarch to SCC in relation to ZB786 - delayed 9 hours. Rejected originally because of '[FONT="]number two engine throttle jam on a previous sector' (technical problems), Monarch binned the case, refused to answer and refused to answer CAA. I am at the Directions Questionnaire form and Monarch, in their defence, have said that it was a 'hidden manufacturing defect' ('throttle cable jamming') They report that Airbus held a conference about it in October 2011 and issued a Service Bulletin.
Research suggests it could quite easily be something else - and I can't find any safety bulletins or details of the conference. Any help would be massively appreciated. Must get it back ASAP.

Longden v Monarch airlines, heard at Winchester County Court in 2014 established that cracked windscreens are not automtaically "exceptional circumstances".
Then the European Court of Justice rules last week that mechanical faults are the airlines' responsibility, even unexpected ones. I assume that is why they have finally caved in on my claim.0 -
Not sure about that Longden chap - bit of a cad by all accounts. More to the point, didn't Monarch basically bail out in the end, so that the main point at dispute was never fully tested?
But I think with Huzar and van dear Lans on your side, you were very well placed to counter anything Monarch might throw at you.
