    I booked a holiday through Expedia to Majorca and this then directed me back to Monarch for flights - despite various E-mails advising of their cheap deals on flights I ended up paying through the nose for some rather expensive flights when could have done this direct much cheaper and wanted todraw their attention to this anomaly and if they could make any adjustment - well, thought worth a try although not holding out for much success !!

    Monarch will just say hard luck but if you want to draw attention to the matter you are better posting on their Facebook page and/or tweeting. I have also PM'd you ....more details in your inbox. This thread is for delays/cancellations.

    Does anyone know if Monarch paid out on my flight MON5818 EDI to PMI 15/7/10 or where to look?

    I tried to claim in 2012 but was given the elbow due to the normal unforseen circumstances, but seems things have changed...

    Thanks for the replies, they have certainly re-inforced my view that this is an extremely winnable case:-

    Bircho – The similarities between our cases are quite striking, on the back of your post I’ll also be asking Monarch for a copy ofthe response they sent to Liverpool.

    Mark2Spark – You’ve pretty much mirrored the crux of my case with your posts. The fact that this is a knock-on delay from a previous rotation immediately renders the EC defence as invalid in my eyes. I was also shocked to see the reference to impact damage in the defence as it struck me as if theywere trying to counter their own claim of a “hidden manufacturing defect”!

    JP – Not seen the witness/expert statements as yet, the outline defence is as much as I've received.

    Unbelievably, having just posted this, my Mrs has pointed out that there's a letter from Monarch in the post; they are no longer disputing our claim on this remaining flight.

    My gratitude to all on this forum can not be expressed through a simple post, this whole process has taken me 18 months and without the invaluable advice on this forum I probably would have given up months ago. I have a young daughter and a partner who is just returning to part-time work after illness so I'm sure you can imagine the difference that the money I will receive will make to my family. Without all of you on this site it would probably not have been possible.

    Typical Monarch. As useless at defending as they are flying.

    They definitely do read these pages as in my case against Monarch (Worcester Court) in their defence bundle they reproduced posts from this Page in the hope it would reinforce their case. In the event it obviously didn't help as they failed.

    Anyone know what this means?


    As a result of an order made on 14th August this claim has been transferred to the County Court at Luton.


    Upon it being apparent that the defendant seeks to argue that this claim is distinguishable from Huzar and Liverpool not having the judicial capacity to deal with airline delay case other than case management, where there is no other nexus.


    The claim is transferred to County court at Luton on the grounds of nexus with the defendant to be case managed with 4 other cases and mine.


    Does this mean this will now be at Luton since I was allocated Manchester as requested or just cased managed there?


    Looks like there are other cases pending for this flight I think and they have been moved to Luton, perhaps B&C cases?


    Strange how Monarch insist a knock on delay plus the fact it was a flat tyre is different from a tech problem.


    No direction as yet be the claim has been moved from Manchester to Liverpool now to Luton. No idea what order was made last week!


    Tomorrow should of been the last day Monarch should have told the court of other cases for this. Also there is no option to appeal this on the order.


    Something happened last week as the court notice or order stated to all parties.


    Here we go again, never easy this, a long drawn out process.

    If I have to go to Luton, 178 miles - 3.5 hours down the M6-M1 I will claim costs for the journey not just for me but my wife and son as they are party to the claim and I will take them with me! I will claim their time off work and mine and mileage and overnight stay for 3!

    This reminds me of the Allen case at Liverpool, Jet2 wanted to fight it along with Ryanair and several other cases were all wrapped up into one hearing...

    So my best guess is that whatever they are claiming effects more than your individual case, so they are throwing them all together at Luton, it does say "to be case managed" so I'd wait to find out if it goes to a hearing but directions should be given, that's my uneducated take on it anyway.

    Not necessarily a bad move, perhaps Luton has more specialised DJs like Liverpool?
