So I've received the court date for my claim but in the paperwork it says documentation must be submitted by [28 days]. Is this 28 days from the letter arriving or 28 days before the hearing date?
I've tried to phone the court but despite being promised a phone call back I've heard nothing! Need to get my dates correct so as not to miss any deadlines.Determined to save and not squander!

Why don't you tell us exactly what the letter from the court says - verbatim. Otherwise it's difficult to help.0 -
I have heard that on some claim refusals monarch are stating that reason for delay etc. are private and confidential - why would they be doing that?0

sbworcs - in order that other people on the same flight are not alerted that a potential claim will succeed. In addition they never like admitting there was a fault with their plane as they worry that passengers may start to realise they have potential technical problems with their planes not being experienced by another airline.0

My case has now been moved to Liverpool for assessment. Not sure if this is good news or not.Check out Vaubans Flight Delay Guide, you will be glad you did....

This happened after sitting at end of runway for 30 mins.
It's a valve thingy, spare being flown from Gatwick, due in around 22.00.
Quickly organised bus transfer and hotel accommodation, food etc. although poor comms in airport so lots of folk with problems.
Otherwise info is sparse at the moment, but we think we'll be leaving hotel after 22.00 back to airport.
Initially tried claiming via resolver.co.uk - don't waste your time as heard diddly from anyone.
I then sent an email on 28/6/15 to euclaim@ email, enclosing:
both eu claim form and Monarch's own (completed for each passenger),
copy of booking itinerary,
scanned copies of both boarding cards,
scan of Monarch letter given at Tenerife South airport,
authority to claim from the current Mrs theboylard
and outlining my claim under 261/400 for €400 each - no flannel, just the facts.
Hadn't heard anything by today, so sent same email to CEO of Monarch and the euclaim address, advising Notice before Action etc.
1½ hours later an email from Monarch lands, advising that cheques had been sent on Tuesday for both of us and they apologise that we had not receieved an email from them confirming they were accepting our claim!
I'll post confirmation when they land, hopefully no delays with this
Very pleased with the lack of effort required on my part!
A big up! to Vauban for his guide, and to others on here for raising this important issue.4kWp, SSE, SolarEdge P300 optimisers & SE3500 Inverter, in occasionally sunny Corby, Northants.
Now with added Sunsynk 5kw hybrid ecco inverter & 15kWh Fogstar batteries. Oh Octopus Energy too.0 -
Just over two weeks until the trial, and I'm finishing off my bundle this weekend. I've read Vauban's guide, but there's one thing I'm not sure about. Are the "particulars of claim" supposed to be a more detailed version of the particulars that I initially stated when I started my court claim? Should I update them with the total amount I'm now claiming, including the 8% interest that has accrued over the past two years since I started the claim? I ask because I don't see any amounts in the document referenced by Vauban's Guide.
By the way, the venue was changed last month to the Royal Courts of Justice; no reason was given. Has anyone got any experience of that?0 -

Yes. You it gives more detail about what you are claiming and why - including the basic legal argument. I attach a copy of mine here:

This is quite out of date now, given the subsequent cases in the Court of Appeal. But that should make it easier for you. You will presumably need to swap bundles imminently, according to the Court's Order?
You don't need to include a revised costing - but take along a separate paper on the day, which has the up to date figures - including interest at 8% (I assume you claimed for this in your original claim?)By the way, the venue was changed last month to the Royal Courts of Justice; no reason was given. How weird - is that Court local to you? Lovely building mind ...0 -
Yes, thanks, Vauban. I will be posting the bundle on Monday (or Tuesday at the latest). The move is weird, but not totally unexpected because the case kept being passed to and fro between my local court (in the suburbs) and another one in London. It's as if neither court really wanted to take on the case. The Royal Courts of Justice do look very pretty, and are only a short train ride away and there are some nice pubs nearby to celebrate afterwards. :beer:0
